AN ACT 1 Amending the act of March 11, 1971 (P.L.104, No.3), entitled, as 2 reenacted and amended, "An act providing property tax or rent 3 rebate and inflation dividends to certain senior citizens, 4 widows, widowers and permanently disabled persons with 5 limited incomes; establishing uniform standards and 6 qualifications for eligibility to receive rebates and 7 dividends; providing for transportation assistance grants and 8 grants to area agencies on aging for services to older 9 persons; and imposing duties upon the Department of Revenue," 10 providing for energy credits. 11 The General Assembly of the Commonwealth of Pennsylvania 12 hereby enacts as follows: 13 Section 1. Section 3, act of March 11, 1971 (P.L.104, No.3), 14 known as the "Senior Citizens Rebate and Assistance Act," is 15 amended by adding definitions to read: 16 Section 3. Definitions.--As used in this act: 17 * * * 18 (10) "Energy company" means every retail propane dealer that 19 distributes propane by pipeline and every electric light, rural 20 electric, gas or natural gas company.
1 (11) "Energy credit" means a payment made to or on behalf of 2 a claimant in accordance with the provisions of section 4.1. 3 Section 2. The act is amended by adding a section to read: 4 Section 4.1. Energy credits.--(a) For the purpose of this 5 section a "claimant" is any person who meets the definition of 6 "claimant" in section 3 and who earns less than seven thousand 7 dollars ($7,000) per year. 8 (b) In addition to any rebate, dividend or other payment, 9 each claimant shall receive an energy credit of one hundred 10 dollars ($100) to be paid in accordance with the provisions of 11 subsections (c) and (d). 12 (c) Each claimant who receives a monthly bill or statement 13 from an energy company shall have the sum of twenty dollars 14 ($20) credited to his bill each December, January, February, 15 March and April, so that a total of one hundred dollars ($100) 16 is credited to his account during those five months. 17 (d) Each claimant who is not provided for in subsection (c) 18 shall receive one hundred dollars ($100) as an energy credit. 19 The one hundred dollars ($100) credit shall be forwarded to the 20 claimant at the same time the rebate and/or dividend checks are 21 forwarded. 22 (e) Every energy company shall comply with the provisions of 23 this section together with the implementing regulations 24 promulgated by the department. 25 (f) The department shall adopt the regulations necessary to 26 carry out the provisions of this section which regulations shall 27 provide for the prompt reimbursement to energy companies of 28 energy credits granted under this section. 29 Section 3.
