AN ACT 1 Amending the act of August 21, 1953 (P.L.1273, No.361), entitled 2 "An act to regulate the business of private detectives, 3 investigators and watch, guard, or patrol agencies, and the 4 licensing thereof in each county; providing penalties," 5 further excluding certain persons from the provisions of the 6 act. 7 The General Assembly of the Commonwealth of Pennsylvania 8 hereby enacts as follows: 9 Section 1. Section 15, act of August 21, 1953 (P.L.1273, 10 No.361), known as "The Private Detective Act of 1953," is 11 amended to read: 12 Section 15. Application of Act.--Nothing in this act shall 13 apply to any detective officer or man belonging to the 14 Pennsylvania State Police, or to the police force of any county, 15 city, borough, township, or incorporated town, or any employe of 16 such State Police, or such police force, appointed or elected by
1 due authority of law, while engaged in the performance of their 2 official duties or, IF THE BONDING REQUIREMENTS OF SECTION 6 ARE <-- 3 FULFILLED, while in engaged off-duty in the performance of <-- 4 duties as set forth in clause 11 of subsection (b) of section 2, 5 nor to any person, partnership, association, or corporation, or 6 any bureau or agency, whose business is exclusively the 7 furnishing of information as to the business and financial 8 standing and credit responsibility of persons, partnerships, 9 associations, or corporations, or as to the personal habits and 10 financial responsibility of applicants for insurance, indemnity 11 bonds, or commercial credit, or of claimants under insurance 12 policies, and whose business does not embrace other activities 13 described in section 2 of this act, nor to any corporation duly 14 authorized by the Commonwealth to operate a fire alarm 15 protection business, nor to any person while engaged in the 16 business of adjuster for an insurance company, nor to any person 17 regularly employed as special agent, detective or investigator 18 exclusively by one employer in connection with the affairs of 19 that employer only, nor to any charitable or philanthropic 20 society or association duly incorporated under the laws of the 21 Commonwealth and which is organized and maintained for the 22 public good and not for private profit, nor shall anything in 23 this act contained be construed to affect in any way attorneys 24 or counselors at law in the regular practice of their 25 profession, but such exemption shall not enure to the benefit of 26 any employe or representative of such attorney or counselor at 27 law who is not employed solely, exclusively and regularly by 28 such attorney or counselor at law, nor to persons in the 29 exclusive employment of common carriers subject to regulation by 30 the interstate commerce commission or the Public Utility 19820H2524B3526 - 2 -
1 Commission of the Commonwealth of Pennsylvania, nor to 2 investigators in the employment of credit bureaus. [No] Except 3 for the duties set forth in clause (11) of subsection (b) of 4 section 2 which may be performed by any detective officer or a 5 member of the Pennsylvania State Police or to the police force <-- 6 of any county, city, borough, township or incorporated town, or 7 any employe of such State Police or such police force appointed 8 or elected by due authority of law, no person, partnership, 9 association, corporation, or any bureau or agency, exempted 10 hereunder from the application of this act, shall perform any 11 manner of detective service as described in section 2 hereof for 12 any other person, partnership, association, corporation, bureau 13 or agency, whether for fee, hire, reward, other compensation, 14 remuneration, or consideration, or as an accommodation without 15 fee, reward, or remuneration, or by a reciprocal arrangement 16 whereby such services are exchanged on request of parties 17 thereto. The commission of a single act prohibited by this act 18 shall constitute a violation thereof. 19 Nothing in this act shall be construed to affect or prohibit 20 the right of any person to form, or become affiliated with, or 21 to continue as a member of, any union, association, society, or 22 organization of his own choosing. 23 Section 2.
