        SENATOR McKINNEY, STATE GOVERNMENT, IN SENATE, AS AMENDED,
           SEPTEMBER 26, 1978

                                     AN ACT

     1  Authorizing the Department of General Services, with the
     2     approval of the Department of Environmental Resources, to
     3     sell and convey to the City of Philadelphia certain lands
     4     within the bed of the Delaware River in the Fifth Ward of the
     5     City of Philadelphia, Pennsylvania.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  The Department of General Services, with the
     9  concurrence of the Department of Environmental Resources, acting
    10  on behalf of the Commonwealth of Pennsylvania, for a
    11  consideration of $1, is hereby authorized to convey in fee to
    12  the City of Philadelphia lands within the bed of the Delaware
    13  River in the City of Philadelphia, lying between the Bulkhead
    14  and Pierhead Lines of the Delaware River, as approved by the
    15  United States War Department on September 10, 1940, and between
    16  a point north of the north line of Market Street produced, and a
    17  point north of the north line of Cherry Street produced, in the
    18  Fifth Ward of the City of Philadelphia, containing 11.0853


     1  acres, more or less, and more fully described as follows:
     2     All that certain tract of parcel of land situate in the Fifth
     3  Ward of the City of Philadelphia, Pennsylvania, as described as
     4  follows:
     5     Beginning at a point on the easterly side of Delaware Avenue
     6  (variable width), also the Bulkhead Line as established by the
     7  Secretary of War on September 10, 1940, located north 14 degrees
     8  03 minutes 50 seconds east at the distance of 147 feet 0 inches
     9  from an angle point, which angle point is also the point of
    10  intersection of the said easterly side of Delaware Avenue with
    11  the northerly side of Market Street (100 feet wide) produced;
    12  thence extending north 14 degrees 03 minutes 50 seconds east
    13  along the said easterly side of Delaware Avenue, also the said
    14  Bulkhead Line, the distance of 856 feet 0 3/4 inches to a point;
    15  thence south 79 degrees 49 minutes 31 seconds east the distance
    16  of 534 feet 7 1/2 inches to a point on the Pierhead Line as
    17  established by the Secretary of War on September 10, 1940;
    18  thence extending southwardly along the said Pierhead Line the
    19  following courses and distances: (1) south 14 degrees 51 minutes
    20  14 seconds west 332 feet 10 1/2 inches to a point; (2) south 11
    21  degrees 13 minutes 56 seconds west 579 feet 10 1/4 inches to a
    22  point; thence north 80 degrees 06 minutes 20 seconds west 371
    23  feet 11 3/8 inches to a point; thence north 09 degrees 53
    24  minutes 40 seconds east the distance of 60 feet 1 5/8 inches to
    25  a point; thence north 80 degrees 06 minutes 20 seconds west the
    26  distance of 182 feet 7 3/8 inches to a point on the easterly
    27  side of Delaware Avenue, also the said Bulkhead Line, the first
    28  mentioned point and place of beginning. Containing an area of
    29  11.0853 acres, more or less.
    30     SECTION 2.  THE DEED OF CONVEYANCE SHALL CONTAIN A CLAUSE      <--

     1  THAT THE LAND CONVEYED SHALL BE USED FOR MUNICIPAL PURPOSES BY
     2  THE CITY OF PHILADELPHIA AND IF AT ANY TIME THE CITY OF
     3  PHILADELPHIA CONVEYS SAID LAND OR AUTHORIZES OR PERMITS SAID
     4  LAND TO BE USED FOR ANY PURPOSE OTHER THAN MUNICIPAL PURPOSES
     5  THE TITLE THERETO SHALL IMMEDIATELY REVERT TO AND REVEST IN THE
     6  COMMONWEALTH OF PENNSYLVANIA.
     7     Section 2 3.  The deed of conveyance hereby contemplated       <--
     8  shall be approved by the Department of Justice and shall be
     9  executed by the Department of General Services, with the
    10  approval of the Department of Environmental Resources, in the
    11  name of the Commonwealth of Pennsylvania.
    12     Section 3 4.  This act shall take effect immediately.          <--
