AN ACT 1 Amending the act of April 9, 1929 (P.L.177, No.175), entitled 2 "An act providing for and reorganizing the conduct of the 3 executive and administrative work of the Commonwealth by the 4 Executive Department thereof and the administrative 5 departments, boards, commissions, and officers thereof, 6 including the boards of trustees of State Normal Schools, or 7 Teachers Colleges; abolishing, creating, reorganizing or 8 authorizing the reorganization of certain administrative 9 departments, boards, and commissions; defining the powers and 10 duties of the Governor and other executive and administrative 11 officers, and of the several administrative departments, 12 boards, commissions, and officers; fixing the salaries of the 13 Governor, Lieutenant Governor, and certain other executive 14 and administrative officers; providing for the appointment of 15 certain administrative officers, and of all deputies and 16 other assistants and employes in certain departments, boards, 17 and commissions; and prescribing the manner in which the 18 number and compensation of the deputies and all other 19 assistants and employes of certain departments, boards and 20 commissions shall be determined," further providing for 21 membership on the State Board of Optometrical Examiners. 22 The General Assembly of the Commonwealth of Pennsylvania 23 hereby enacts as follows: 24 Section 1. Section 415, act of April 9, 1929 (P.L.177, 25 No.175), known as "The Administrative Code of 1929," amended May 26 2, 1949 (P.L.781, No.193), is amended to read: 27 Section 415. State Board of Optometrical Examiners.--The
1 State Board of Optometrical Examiners shall consist of the 2 [Superintendent of Public Instruction] Commissioner of 3 Professional and Occupational Affairs, and [seven] nine members, 4 [all] seven of whom shall be optometrists, citizens of 5 Pennsylvania, who possess the requisite qualifications to 6 practice optometry under the laws of this Commonwealth, and who 7 shall have been so practicing in this Commonwealth during the 8 five years immediately preceding their appointment and two 9 members of the public at large not members of the healing arts 10 profession or the ophthalmic industry. 11 The terms of members of the board shall be four years from 12 the respective dates of their appointment. 13 No member of the board shall be a member of the faculty of 14 any undergraduate school or college teaching optometry. 15 [Four] Five members of the board shall constitute a quorum, 16 and the board shall select, from its membership, a chairman, and 17 shall elect a secretary who need not be a member of the board. 18 The members of the board, other than the [Superintendent of 19 Public Instruction] Commissioner of Professional and 20 Occupational Affairs, shall receive [fifteen] fifty dollars per 21 diem for each day actually devoted to the work of the board, and 22 the secretary shall receive such reasonable compensation as 23 shall be determined by the board[, with the approval of the 24 Superintendent of Public Instruction]. 25 Section 2.
