                                     AN ACT

     1  Amending the act of June 19, 1961 (P.L.453, No.225), entitled
     2     "An act requiring employers to pay for medical examination
     3     fee where such examination is a condition for employment, and
     4     providing a penalty," further regulating requirements of
     5     medical examinations for employment.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Sections 1 and 2 of the act of June 19, 1961
     9  (P.L.453, No.225), entitled "An act requiring employers to pay
    10  for medical examination fee where such examination is a
    11  condition for employment, and providing a penalty," are amended
    12  to read:
    13     Section 1.  As used in this act--
    14     (1)  "Employer" means an individual, partnership, association
    15  or corporation, a legal representative, trustee, receiver,
    16  trustee in bankruptcy, and any common carrier by rail, motor,
    17  water, air or express company, doing business in or operating
    18  within the Commonwealth. The term "employer" shall include the

     1  Commonwealth of Pennsylvania.
     2     (2)  "Employe" includes every person who may be permitted,
     3  required or directed by any employer, as defined in section 2,
     4  in consideration of direct or indirect, gain or profit, to
     5  engage in any employment.
     6     Section 2.  It shall be unlawful for any employer to require
     7  any employe or applicant for employment to pay the cost of a
     8  medical examination, or the cost of furnishing any medical
     9  records, required by the employer as a condition of employment,
    10  if the applicant or employe works for the employer for one work
    11  week[: Provided, That the provisions of this act shall not apply
    12  where medical examination is required by law as a condition of
    13  employment].
    14     Section 2.  This act shall take effect immediately.
