                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, requiring operators of certain vehicles and
     3     combinations to remove ice and snow representing a hazard to
     4     other persons and vehicles; and imposing a penalty and
     5     mandatory minimum sentence.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Title 75 of the Pennsylvania Consolidated
     9  Statutes is amended by adding a section to read:
    10  § 4905.1.  Duty to remove ice and snow.
    11     (a)  General rule.--No person may operate a vehicle or
    12  combination to which this chapter applies without first removing
    13  from the vehicle or combination any ice or snow which represents
    14  a hazard to other vehicles or persons.
    15     (b)  Penalty.--A violation of this section is a summary
    16  offense.
    17     (c)  Mandatory minimum sentence.--Notwithstanding any other


     1  provision of law to the contrary, a person who violates this
     2  section shall be sentenced to pay a fine of not less than $300
     3  nor more than $1,000 and to undergo imprisonment for not less
     4  than 30 days nor more than 90 days.
     5     Section 2.  This act shall take effect in 60 days.
