AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, further providing for security to cover costs of
3 repairs and restoration necessitated by permitted movement of
4 vehicles.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Section 4902(c) of Title 75 of the Pennsylvania
8 Consolidated Statutes is amended and the section is amended by
9 adding a subsection to read:
10 § 4902. Restrictions on use of highways and bridges.

12 (c) Permits and security.--The Commonwealth and local
13 authorities may issue permits for movement of vehicles of size
14 and weight in excess of restrictions promulgated under
15 subsections (a) and (b) with respect to highways and bridges
16 under their jurisdiction and may require such undertaking or
17 security as they deem necessary to cover the cost of repairs and
18 restoration necessitated by the permitted movement of vehicles.
1 The security may be in the form of a performance bond with
2 surety by a company authorized to do business in this
3 Commonwealth or, at the option of the posting authority, in the
4 form of a certified or cashier's check, bank account or
5 irrevocable letter of credit in favor of the posting authority
6 or in some other form of security acceptable to the posting
7 authority.

9 (h) Definition.--As used in this section the term "posting
10 authority" means the Department of Transportation, as to State-
11 designated highways, and local authorities, as to all other
12 streets and highways.
13 Section 2. This act shall take effect in 60 days.
