                                     AN ACT

     1  Amending the act of December 19, 1988 (P.L.1262, No.156),
     2     entitled, as amended, "An act providing for the licensing of
     3     eligible organizations to conduct games of chance, for the
     4     licensing of persons to distribute games of chance, for the
     5     registration of manufacturers of games of chance, and for
     6     suspensions and revocations of licenses and permits;
     7     requiring records; providing for local referendum by
     8     electorate; and prescribing penalties," further providing for
     9     a definition of "club."

    10     The General Assembly of the Commonwealth of Pennsylvania
    11  hereby enacts as follows:
    12     Section 1.  The definition of "club" in section 3 of the act
    13  of December 19, 1988 (P.L.1262, No.156), known as the Local
    14  Option Small Games of Chance Act, amended December 19, 1990
    15  (P.L.812, No.195), is amended to read:
    16  Section 3.  Definitions.
    17     The following words and phrases when used in this act shall
    18  have the meanings given to them in this section unless the
    19  context clearly indicates otherwise:

    21     "Club."  A club, as defined in section 102 of the act of

     1  April 12, 1951 (P.L.90, No.21), known as the Liquor Code, that
     2  qualifies as an exempt organization under section 501(c) or 527
     3  of the Internal Revenue Code of 1954 (68A Stat. 3, 26 U.S.C. §
     4  501(c) or 527) and is licensed to sell liquor at retail and has
     5  a charitable, religious or civic purpose or is organized to
     6  benefit a political party. The term "club" shall also include a
     7  club that qualifies as an exempt organization under section
     8  501(c) or 527 of the Internal Revenue Code of 1954 (68A Stat. 3,
     9  26 U.S.C. § 501(c) or 527) which is organized to benefit a
    10  political party, but is not licensed to sell liquor at retail.
    11  This term shall not be construed to mean a candidate for
    12  political office, nor shall it mean a committee organized to
    13  benefit a candidate for political office.

    15     Section 2.  This act shall take effect immediately.
