A JOINT RESOLUTION 1 Proposing amendments to the Constitution of the Commonwealth of 2 Pennsylvania, providing for the increase or decrease of 3 expense allowances during the current term of appointment or 4 election of the General Assembly. 5 WHEREAS, Section 8 of Article II of the Constitution of 6 Pennsylvania provides for the salary and mileage of the members 7 of the General Assembly, however, there is no mention of an 8 expense allowance; and 9 WHEREAS, Section 27 of Article III of the Constitution of 10 Pennsylvania prohibits a change in the term of office or salary 11 of any public officer after his election or appointment; and 12 WHEREAS, The Supreme Court of Pennsylvania has found that 13 those sections are not violated by the provisions of the act of 14 September 30, 1983 (P.L.160, No.39), known as the Public 15 Official Compensation Law. 16 The General Assembly of the Commonwealth of Pennsylvania 17 hereby resolves as follows: 18 Section 1. The following amendments to the Constitution of
1 Pennsylvania are proposed in accordance with Article XI: 2 (1) That section 8 of Article II be amended to read: 3 § 8. Compensation. 4 The members of the General Assembly shall receive such 5 salary, expense allowance and mileage for regular and special 6 sessions as shall be fixed by law, and no other compensation 7 whatever, whether for service upon committee or otherwise. No 8 member of either House shall during the term for which he may 9 have been elected, receive any increase of salary, expense 10 allowance or mileage, under any law passed during such term. 11 (2) That section 27 of Article III be amended to read: 12 § 27. Changes in term of office or salary prohibited. 13 No law shall extend the term of any public officer, or 14 increase or diminish his salary or emoluments, after his 15 election or appointment. Notwithstanding the foregoing 16 limitations, no law varying the compensation for the services of 17 the General Assembly shall take effect until an election of 18 Representatives shall have intervened.
