AN ACT
1 Amending the act of November 10, 1965 (P.L.721, No.346),
2 entitled "An act relating to anthracite coal mines; amending,
3 revising, consolidating and changing the laws relating
4 thereto; providing for the health and safety of persons
5 employed in and about the anthracite coal mines of
6 Pennsylvania, and for the protection and preservation of
7 property connected therewith; prescribing powers and duties
8 in connection therewith; prescribing penalties, and repealing
9 existing laws," MAKING A REPEAL AND prohibiting the use of <--
10 internal combustion engines in underground coal mines.
11 The General Assembly of the Commonwealth of Pennsylvania
12 hereby enacts as follows:
13 Section 1. The act of November 10, 1965 (P.L.721, No.346),
14 known as the "Pennsylvania Anthracite Coal Mine Act," is amended
15 by adding a section to read:
16 Section 416. Internal Combustion Engines Prohibited.--The
17 use of an internal combustion engine shall not be permitted in
18 any underground coal mine, EXCEPT THAT ANY INTERNAL COMBUSTION <--
19 ENGINE WHICH HAS MET WITH THE APPROVAL OF THE SECRETARY FOR USE
20 IN AN UNDERGROUND COAL MINE PRIOR TO THE EFFECTIVE DATE OF THIS
21 ACT, MAY, SUBJECT TO AT LEAST TWICE PER YEAR INSPECTIONS,
1 CONTINUE IN OPERATION UNTIL THE USEFUL LIFE OF SUCH ENGINE SHALL
2 EXPIRE.
3 SECTION 2. SECTION 802 OF THE ACT IS REPEALED.
4 Section 2 3. This act shall take effect immediately. <--
