        AS REPORTED FROM COMMITTEE ON STATE GOVERNMENT, HOUSE OF
           REPRESENTATIVES, AS AMENDED, JANUARY 28, 1992

                                     AN ACT

     1  Amending the act of December 17, 1990 (P.L.742, No.185),
     2     entitled "An act providing for restrooms in facilities where
     3     the public congregates; and requiring that restroom
     4     facilities be provided for women on an equitable basis,"
     5     further providing for the definition of "facilities where the
     6     public congregates"; and requiring diaper changing areas in
     7     men's AND WOMEN'S restrooms.                                   <--

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  The title and section 1 of the act of December
    11  17, 1990 (P.L.742, No.185), entitled, "An act providing for
    12  restrooms in facilities where the public congregates; and
    13  requiring that restroom facilities be provided for women on an
    14  equitable basis," are amended to read:
    15                               AN ACT
    16  Providing for restrooms in facilities where the public
    17     congregates; [and] requiring that restroom facilities be
    18     provided for women on an equitable basis; and requiring
    19     diaper changing areas in men's AND WOMEN'S restrooms.          <--


     1  Section 1.  Statement of purpose.
     2     The purpose of this act is to end the inequitable delays
     3  which women face when they need to use restroom facilities in
     4  public places when men are rarely required to wait for the same
     5  purpose and to facilitate changing of infants' diapers by men
     6  AND WOMEN in restroom facilities.                                 <--
     7     Section 2.  The definition of "facilities where the public
     8  congregates" in section 2 of the act is amended to read:
     9  Section 2.  Definitions.
    10     The following words and phrases when used in this act shall
    11  have the meanings given to them in this section unless the
    12  context clearly indicates otherwise:
    13     * * *
    14     "Facilities where the public congregates."  Sports and
    15  entertainment arenas, stadiums, community and convention halls,
    16  specialty event centers, amusement facilities, ski resorts,
    17  public airports and public middle schools and high schools. The
    18  term includes specialty event centers in public parks.

    20     Section 3.  Section 3 of the act is amended to read:
    21  Section 3.  Restroom requirements.
    22     (a)  Number of water closets and lavatories.--Publicly and
    23  privately owned facilities where the public congregates shall be
    24  equipped with sufficient temporary or permanent restrooms to
    25  meet the needs of the public at peak hours. More water closets
    26  and lavatories shall be provided for women than for men by a
    27  ratio determined by the department. Facilities shall conform
    28  with and be approved by the department in accordance with the
    29  provisions of the act of April 27, 1927 (P.L.465, No.299),
    30  referred to as the Fire and Panic Act.

     1     (b)  Diaper changing area.--
     2         (1)  Water closets and lavatories for men AND WOMEN in     <--
     3     facilities where the public congregates shall contain an area
     4     designed and devoted exclusively for the changing of diapers
     5     or similar garments worn by infants.
     6         (2)  Paragraph (1) shall not apply to public middle
     7     schools and high schools.
     8     Section 4.  This act shall apply to facilities where
     9  construction or renovation commences on or after the effective
    10  date of this act.
    11     Section 5.  This act shall take effect in 120 days.
