AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, further regulating speed of trucks with gross 3 weight exceeding 9,000 pounds. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Sections 3362(a), 3363 and 6110(a) of Title 75 of 7 the Pennsylvania Consolidated Statutes are amended to read: 8 § 3362. Maximum speed limits. 9 (a) General rule.--Except when a special hazard exists that 10 requires lower speed for compliance with section 3361 (relating 11 to driving vehicle at safe speed), the limits specified in this 12 section or established under this subchapter shall be maximum 13 lawful speeds and no person shall drive a vehicle at a speed in 14 excess of the following maximum limits: 15 (1) 35 miles per hour in any urban district. 16 (1.1) 65 miles per hour for all vehicles except trucks 17 having a registered gross weight of more than 9,000 pounds:
1 (i) on interstate highways outside of urbanized 2 areas of population of 50,000 or more; and 3 (ii) on other freeways where the department has 4 posted a 65-miles-per-hour speed limit in accordance with 5 the provisions of 23 U.S.C. (relating to highways). 6 (2) 55 miles per hour in other locations. 7 (3) Any other maximum speed limit established under this 8 subchapter. 9 * * * 10 § 3363. Alteration of maximum limits. 11 The department or local authorities on highways under their 12 respective jurisdictions, upon the basis of an engineering and 13 traffic investigation, may determine that the maximum speed 14 permitted under this subchapter is greater or less than is 15 reasonable and safe under the conditions found to exist upon any 16 such highway or part thereof and establish a reasonable and safe 17 maximum limit. The maximum speed limit may be made effective at 18 all times or at times indicated and may vary for different 19 weather conditions and other factors bearing on safe speeds. No 20 maximum speed greater than 55 miles per hour shall be 21 established under this section except on highways listed in 22 section 3362(a)(1.1) (relating to maximum speed limits), where 23 the maximum speed for all vehicles except trucks having a 24 registered gross weight of more than 9,000 pounds shall not be 25 greater than 65 miles per hour. 26 § 6110. Regulation of traffic on Pennsylvania Turnpike. 27 (a) General rule.--The provisions of this title apply upon 28 any turnpike or highway under the supervision and control of the 29 Pennsylvania Turnpike Commission unless specifically modified by 30 rules and regulations promulgated by the commission which shall 19980H2090B2739 - 2 -
1 become effective only upon publication in accordance with law. A 2 copy of the rules and regulations, so long as they are 3 effective, shall be posted at all entrances to the turnpike or 4 highway for the inspection of persons using the turnpike or 5 highway. This section does not authorize the establishment of a 6 maximum speed limit greater than 55 miles per hour, except that 7 a 65-miles-per-hour maximum speed limit for all vehicles except 8 trucks having a registered gross weight of more than 9,000 9 pounds may be established: 10 (1) on interstate highways outside of urbanized areas of 11 population of 50,000 or more; and 12 (2) on other freeways where the commission has posted a 13 65-miles-per-hour speed limit in accordance with the 14 provisions of 23 United States Code (relating to highways). 15 * * * 16 Section 2.
