                                     AN ACT

     1  Amending Title 20 (Decedents, Estates and Fiduciaries) of the
     2     Pennsylvania Consolidated Statutes, further providing for
     3     small estates of minors.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 5101 of Title 20 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 5101.  When guardian unnecessary.
     9     When the entire real and personal estate, wherever located,
    10  of a resident or nonresident minor has a net value of [$10,000]
    11  $24,000 or less, all or any part of it may be received and held
    12  or disposed of by the minor, or by the parent or other person
    13  maintaining the minor, without the appointment of a guardian or
    14  the entry of security, in any of the following circumstances:
    15         (1)  Award from decedent's estate or trust.--When the


     1     court having jurisdiction of a decedent's estate or of a
     2     trust in awarding the interest of the minor shall so direct.
     3         (2)  Interest in real estate.--When the court having
     4     jurisdiction to direct the sale or mortgage of real estate in
     5     which the minor has an interest shall so direct as to the
     6     minor's interest in the real estate.
     7         (3)  Other circumstances.--In all other circumstances,
     8     when the court which would have had jurisdiction to appoint a
     9     guardian of the estate of the minor shall so direct.
    10     Section 2.  This act shall be retroactive to January 1, 1991.
    11     Section 3.  This act shall take effect immediately.
