                                     AN ACT

     1  Amending the act of July 1, 1981 (No.5-A), entitled "An act to
     2     provide for the expenses of the Executive, Legislative and
     3     Judicial Departments of the Commonwealth, the public debt and
     4     for the public schools for the fiscal period July 1, 1981 to
     5     June 30, 1982, and for the payment of bills incurred and
     6     remaining unpaid at the close of the fiscal period ending
     7     June 30, 1981; itemizing appropriations of the Federal
     8     Augmentation to the Executive and Judicial Departments of the
     9     Commonwealth, establishing restricted receipts accounts for
    10     the fiscal period July 1, 1981 to June 30, 1982 and for the
    11     payment of bills incurred and remaining unpaid at the close
    12     of the fiscal period ending June 30, 1981 and to provide
    13     additional and supplemental appropriations from the General
    14     Fund and the Motor License Fund to the various departments of
    15     the Commonwealth for the fiscal period July 1, 1980 to June
    16     30, 1981," increasing the appropriation for special education
    17     and removing certain limiting provisions relating to the
    18     payment of the basic instructional subsidies.

    19     The General Assembly of the Commonwealth of Pennsylvania
    20  hereby enacts as follows:
    21     Section 1.  As much as relates to the Department of Education
    22  in section 201, act of July 1, 1981 (No.5-A), known as the
    23  "General Appropriation Act of 1981," is amended to read:
    24     Section 201.  The following sums, or as much thereof as may
    25  be necessary, are hereby specifically appropriated from the
    26  General Fund to the several hereinafter named agencies of the

     1  Executive, Legislative and Judicial Departments of the
     2  Commonwealth for the payment of salaries, wages or other
     3  compensation and travel expense of the duly elected or appointed
     4  officers and employees of the Commonwealth, for payment of fees
     5  of contractual services rendered, for the purchase or rental of
     6  goods, services, printing, equipment, land and buildings and for
     7  payment of any other expenses, as provided by law or by this
     8  act, necessary for the proper conduct of the duties, functions
     9  and activities and for the purposes hereinafter set forth for
    10  the fiscal period beginning July 1, 1981 and for the payment of
    11  bills incurred and remaining unpaid at the close of the fiscal
    12  period ending June 30, 1981.

    16     For payment of subsidies to school districts
    17  on account of basic instructional costs: Provided,
    18  That the Secretary of Education, with the approval
    19  of the Governor, may make payments from this
    20  appropriation in advance of the due date prescribed
    21  by law to school districts which are financially
    22  handicapped, whenever he shall deem it necessary
    23  to make such advanced payments to enable the
    24  school districts to keep their public schools
    25  open[: Provided further, That no school district
    26  shall receive an increase in basic instructional
    27  subsidy in Commonwealth fiscal year 1981-1982 which
    28  is more than $4,919,000 greater than the amount
    29  received as basic instructional subsidy in the
    30  Commonwealth fiscal year 1980-1981].............. 1,544,000,000

     2     For payments to school districts, intermediate
     3  units and approved private schools on account of
     4  special education of exceptional children.
     5  The additional $24,000,000 dollars is for past
     6  debts due to school districts of the first class.  [$228,073,000]
