AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, imposing a duty upon insurers to give notice of 3 cancellation of motor vehicle liability insurance policies; 4 providing for the revocation and seizure of certain drivers' 5 licenses; and imposing a penalty. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. Title 75 of the Pennsylvania Consolidated 9 Statutes is amended by adding sections to read: 10 § 1725. Obligation of insurer to report cancellation of policy. 11 (a) General rule.--An insurer who has issued a contract of 12 motor vehicle liability insurance and knows or has reason to 13 believe that the contract is for the purpose of providing 14 financial responsibility shall immediately notify the Department 15 of Transportation if the insurance has been canceled or 16 terminated by the insured or by the insurer. The insurer shall 17 notify the department not later than ten days following the 18 effective date of the cancellation or termination.
1 (b) Penalty.--An insurer that fails to give the notice 2 required by subsection (a) commits a summary offense and shall, 3 upon conviction, be sentenced to pay a fine of not less than 4 $500. 5 § 1784.1. Revocation of operating privilege. 6 (a) Action by Department of Transportation.--Upon receiving 7 the notice required by section 1725 (relating to obligation of 8 insurer to report cancellation of policy) the department shall 9 revoke the operating privilege of a person whose motor vehicle 10 liability insurance has been canceled or terminated unless the 11 person provides to the department within seven days of the date 12 notice is received by the department proof of financial 13 responsibility satisfactory to the department. 14 (b) Notice of revocation.--The department shall notify the 15 Pennsylvania State Police and all municipal police departments 16 in this Commonwealth of the names of all persons whose operating 17 privileges have been revoked under subsection (a). 18 (c) Seizure of driver's license.--The State Police and 19 municipal police officers shall have the power to seize the 20 driver's license of a person whose operating privilege has been 21 revoked under subsection (a). 22 Section 2.
