AN ACT
Amending the act of March 4, 1971 (P.L.6, No.2), entitled "An
act relating to tax reform and State taxation by codifying
and enumerating certain subjects of taxation and imposing
taxes thereon; providing procedures for the payment,
collection, administration and enforcement thereof; providing
for tax credits in certain cases; conferring powers and
imposing duties upon the Department of Revenue, certain
employers, fiduciaries, individuals, persons, corporations
and other entities; prescribing crimes, offenses and
penalties," in city revitalization and improvement zones,
providing for establishment of contracting authority board
for city of the third class.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of March 4, 1971 (P.L.6, No.2), known as
the Tax Reform Code of 1971, is amended by adding a section to
read:
Section 1803.2-C. Establishment of contracting authority board
for city of the third class.
(a) Board composition.--A city of the third class that
designates a contracting authority under section 1803-C shall
establish a authority board consisting of nine members. The
membership shall be as follows:

(1) Three voting members shall be appointed by the mayor
of the city of the third class and shall serve as follows:
(i) One member shall serve a two-year term.
(ii) One member shall serve a three-year term.
(iii) One member shall serve a five-year term.
(2) Three voting members shall be appointed by a member
of the Senate who represents the 49th District of this
Commonwealth and shall serve as follows:
(i) One member shall serve a two-year term.
(ii) One member shall serve a three-year term.
(iii) One member shall serve a five-year term.
(3) Two voting members shall be appointed by a member of
the House of Representatives who represents the 1st District
of this Commonwealth and shall serve as follows:
(i) One member shall serve a two-year term.
(ii) One member shall serve a three-year term.
(4) One voting member shall be appointed by a member of
the House of Representatives who represents the 2nd District
of this Commonwealth and shall serve a five-year term.
(b) Terms.--Terms specified under subsection (a) shall
commence upon the date of appointment. Members may be
reappointed by the same appointing authority for a five-year
term following expiration of the member's initial appointment.
(c) Compensation.--Members of an authority board shall serve
without compensation.
(d) Vacancies.--A vacancy on the authority board shall be
filled by the same appointing authority as the initial
appointment under subsection (a).
(e) Definitions.--As used in this section, the following
words and phrases shall have the meanings given to them in this

subsection unless the context clearly indicates otherwise:
"Authority board." A board established under subsection (a)
to oversee a contracting authority.
"City of the third class." A city that meets all of the
following:
(1) Incorporated under an optional charter.
(2) Located in a county of the third class and a home
rule county.
(3) Is the county's seat.
(4) Has a population between 93,500 and 95,500 based on
the most recent Federal decennial census.
Section 2. This act shall take effect immediately.
