        AS REPORTED FROM COMMITTEE ON TRANSPORTATION, HOUSE OF
           REPRESENTATIVES, AS AMENDED, FEBRUARY 2, 1988

                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, excluding antique motor vehicles from the            <--
     3     Catastrophic Loss Trust Fund charge; and providing that
     4     drivers and occupants of such vehicles shall be ineligible
     5     claimants. FURTHER DEFINING "INELIGIBLE CLAIMANT"; AND MAKING  <--
     6     PAYMENT INTO THE CATASTROPHIC LOSS TRUST FUND OPTIONAL; AND
     7     MAKING REPEALS.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     SECTION 1.  SECTION 1306(7) OF TITLE 75 OF THE PENNSYLVANIA    <--
    11  CONSOLIDATED STATUTES IS REPEALED.
    12     Section 1 2.  The definition of "ineligible claimant" in       <--
    13  section 1761 and section 1762 of Title 75 of the Pennsylvania     <--
    14  Consolidated Statutes are amended to read:
    15  § 1761.  Definitions.
    16     The following words and phrases when used in this subchapter
    17  shall have the meanings given to them in this section unless the
    18  context clearly indicates otherwise:


     1     * * *
     2     "Ineligible claimant."  [Any of the following:                 <--
     3         (1)]  A person who is the owner of a motor vehicle who     <--
     4     has not complied with the registration requirements of
     5     Chapter 13 (relating to registration of vehicles).
     6         [(2)  A person who is the driver or occupant of a          <--
     7     recreational vehicle not intended for highway use, an antique  <--
     8     motor vehicle, a motorcycle, a motorized pedalcycle, a motor-
     9     driven cycle or like type vehicle required to be registered
    10     under this title but not subject to the charge levied in
    11     section 1762 (relating to funding).]                           <--

    13  § 1762.  Funding.
    14     The Catastrophic Loss Trust Fund shall be funded by [levying]  <--
    15  an initial [charge] OPTIONAL PAYMENT of $5 upon [all] motor       <--
    16  vehicles [required to be] registered under Chapter 13 (relating   <--
    17  to registration of vehicles), except trailers, recreational
    18  vehicles not intended for highway use, antique motor vehicles,    <--
    19  motorcycles, motor-driven cycles, motorized pedalcycles or like
    20  type vehicles. [This charge] THE OPTIONAL PAYMENT shall be        <--
    21  remitted to an insurance company or other party as may be
    22  designated by the Insurance Department. Upon receipt of the
    23  [charge] OPTIONAL PAYMENT, the insurance company or other         <--
    24  designated party shall remit it to the Insurance Department for
    25  deposit in the trust fund. The Catastrophic Loss Trust Fund
    26  Board shall, by regulation, determine by January 1 of each
    27  calendar year the amount of the [fund charge] OPTIONAL PAYMENT    <--
    28  for each registration year subsequent to the initial
    29  registration year and shall notify the Insurance Department
    30  which shall notify the insurance companies or other designated

     1  parties to collect the [charge] OPTIONAL PAYMENT.                 <--
     2     SECTION 3.  SECTION 1763 OF TITLE 75 IS REPEALED.              <--
     3     Section 2 4.  This act shall take effect in 60 days.           <--
