Providing for the adoption of capital projects related to the

repair, rehabilitation or replacement of highway bridges and

for the adoption of specific flood mitigation projects or

4

disaster assistance projects to be financed from debt

5

incurred under clause (1) of subsection (a) of section 7 of

6

Article VIII of the Constitution of Pennsylvania.

To the act of December 8, 1982 (P.L.848, No.235), entitled "An

act providing for the adoption of capital projects related to

9

the repair, rehabilitation or replacement of highway bridges

10

to be financed from current revenue or by the incurring of

11

debt and capital projects related to highway and safety

12

improvement projects to be financed from current revenue of

13

the Motor License Fund," itemizing public highway projects to

14

be constructed by the Department of Transportation from

15

current revenue in the Motor License Fund; and stating the

16

estimated useful life of the projects.

The General Assembly of the Commonwealth of Pennsylvania

18

hereby enacts as follows:

CHAPTER 1

PRELIMINARY PROVISIONS

21

Section 101.  Short title.

22

This act shall be known and may be cited as the Disaster

Relief Act of 2011.

CHAPTER 3

BRIDGES

Section 301.  Short title of chapter.

5

This chapter relates to the Capital Budget 2011 for highway-

6

railroad and highway bridges damaged by Hurricane Irene and

7

Tropical Storm Lee.

8

Section 302.  Definitions.

9

The following words and phrases when used in this chapter

10

shall have the meanings given to them in this section unless the

11

context clearly indicates otherwise:

12

"Capital project."  A capital project as defined in section

13

302 of the act of February 9, 1999 (P.L.1, No.1), known as the

14

Capital Facilities Debt Enabling Act, and shall include county

15

or municipal bridge rehabilitation, replacement or improvement

16

projects as set forth in this chapter.

17

"Department."  The Department of Transportation of the

18

Commonwealth.

19

"Secretary."  The Secretary of Transportation of the

20

Commonwealth.

21

Section 303.  Total authorization for bridge projects.

22

The total authorization for the projects itemized pursuant to

23

this chapter and to be financed from debt incurred under clause

24

(1) of subsection (a) of section 7 of Article VIII of the

25

Constitution of Pennsylvania is $75,000,000.

26

Section 304.  Itemization of bridge projects.

27

The individual capital projects in the category of highway

28

projects to be constructed by the department, its successors or

29

assigns, and to be financed from debt incurred under clause (1)

30

of subsection (a) of section 7 of Article VIII of the

Section 372.  Estimated useful life of projects.

The General Assembly states the estimated useful life of the

4

projects itemized in this chapter is 30 years.

5

Section 373.  Federal funds.

6

All moneys received from the Federal Government for the

7

highway and highway bridge projects specifically itemized in

8

this chapter are also hereby appropriated for those projects.

9

Section 374.  Construction.

10

(a)  Utilization of Federal funds.--Amounts contained in this

11

chapter for any project shall not supplant or replace any

12

Federal funds authorized by any Federal law or regulation.

13

Funding from this chapter for any project is available only to

14

the extent that Federal funds are not available for such

15

project.

16

(b)  Continuity with bridge supplementals.--The provisions of

17

this chapter shall be construed unless specifically provided

18

otherwise as a supplement to the act of December 8, 1982

19

(P.L.848, No.235), known as the Highway-Railroad and Highway

20

Bridge Capital Budget Act for 1982-1983.

21

Section 375.  Allocation of funds.

22

Whenever the Department of Transportation determines that the

23

full estimated financial costs of the projects itemized in this

24

chapter are not necessary for the proper design, acquisition or

25

construction of such project, the excess funds no longer

26

required may be allocated by the department to increase the

27

estimated costs of any one or more of the projects specifically

28

itemized in a capital budget.

RAILROAD DISASTER ASSISTANCE PROJECTS

Section 501.  Short title of chapter.

This chapter relates to railroad disaster assistance projects

3

itemization in 2011.

Section 502.  Definitions.

The following words and phrases when used in this chapter

6

shall have the meanings given to them in this section unless the

7

context clearly indicates otherwise:

8

"Disaster."  The period of time in calendar year 2011

9

relating to Hurricane Irene and Tropical Storm Lee that was the

10

subject of a presidential declaration of an emergency under The

11

Robert T. Stafford Disaster Relief and Emergency Assistance Act

12

(Public Law 93-288, 88 Stat. 143).

13

Section 503.  Total authorization.

14

The total authorization for disaster assistance projects to

15

be financed in part with grants as itemized in this chapter is

16

$2,000,000.

17

Section 504.  Itemization of disaster mitigation or assistance

18

projects.

19

The individual disaster mitigation or assistance projects to

20

be financed from current revenues or debt are hereby itemized,

21

together with their respective estimated financial costs, as

22

follows:

Department of Transportation        $2,000,000

24

(1)  Lycoming Valley Railroad       $1,000,000

Section 505.  Funds.

26

The projects itemized in this chapter shall be funded from

27

debt incurred under the provisions of clause (1) of subsection

28

(a) of section 7 of Article VIII of the Constitution of

29

Pennsylvania.

Section 506.  Federal funds.

CHAPTER 20

MISCELLANEOUS PROVISIONS

Section 2001.  Constitutional construction.

13

The provisions of this act shall be severable and, if any of

14

the provisions of this act shall be held unconstitutional, such

15

decisions shall not affect the validity of any of the remaining

16

provisions of this act. It is hereby declared as the legislative

17

intent that this act would have been adopted had such

18

unconstitutional provisions not been included in this act.

Section 2002.  Effective date.

20

This act shall take effect immediately.

Section 1.  Short title.

This act shall be known and may be cited as the Flood

23

Disaster Highway Bridge Project Itemization Act of 2012.

24

Section 2.  Authorization.

25

The total authorization for the capital projects in the

26

category of highway bridge projects itemized in sections 4

27

through 70 and to be constructed by the Department of

28

Transportation, its successors or assigns, and to be financed

29

from the current revenue of the Motor License Fund shall be

30

$49,536,000.

Section 71.  Estimated useful life of projects.

The General Assembly states the estimated useful life of the

projects heretofore itemized is 30 years.

Section 72.  Federal funds.

4

All moneys received from the Federal Government for the

5

construction of the public highway projects specifically

6

itemized herein are also hereby appropriated for those projects.

Section 73.  Construction.

8

Amounts contained in this act for any project shall not

9

supplant or replace any Federal funds authorized by any Federal

10

law or regulation. Funding from this act for any project is

11

available only to the extent that Federal funds are not

12

available for such project.

13

Section 74.  Allocation of funds.

14

Whenever as determined by the Department of Transportation

15

that the full estimated financial costs of the projects itemized

16

in sections 4 through 70 are not necessary for the proper

17

design, acquisition or construction of such projects, the excess

18

funds no longer required may be allocated by the Department of

19

Transportation to increase the estimated costs of any one or

20

more of the projects specifically itemized in a capital budget.

21

Section 75.  Effective date.

22

This act shall take effect immediately.
