AN ACT
1 Authorizing the Department of General Services with the
2 concurrence of the Department of Environmental Resources and
3 the approval of the Governor, to sell and convey to Longwall
4 Mining, Incorporated in the name of the Commonwealth a tract
5 of land in Adams Township, Cambria County, Pennsylvania.
6 The General Assembly of the Commonwealth of Pennsylvania
7 hereby enacts as follows:
8 Section 1. The Department of General Services with the
9 concurrence of the Department of Environmental Resources and the
10 approval of the Governor, acting on behalf of the Commonwealth
11 of Pennsylvania for a consideration which shall be the actual
12 market value of the tract of property hereinafter described as
13 determined by an independent appraisal service chosen by the
14 Secretary of General Services is hereby authorized to convey in
15 fee to Longwall Mining, Incorporated, its successors and
16 assigns, a tract of surface land in Adams Township, Cambria
17 County, Pennsylvania, purchased in May, 1929 by the Commonwealth
18 as the site for a fire tower which has not been in use for the
19 past 15 years and which is no longer of any use to the
1 Commonwealth.
2 The description of the tract to be conveyed is as follows:
3 All that certain tract or parcel of land in Adams Township,
4 Cambria County, Pennsylvania, bounded and described as follows:
5 Beginning at a point, which point is south 62 degrees east
6 27.5 perches distant from the corner of land of J. Rudolph and
7 the Henriette Coal Mining Company; thence along lands of George
8 and Adam Sherly south 62 degrees east 47.1 perches to a post at
9 the corner of the land of George and Adam Sherly and the
10 Henriette Coal Mining Company; thence south 28 degrees west 51
11 perches along the lands of Sherly to a point at the corner of
12 the same; thence along the lands of Henriette Coal Mining
13 Company north 62 degrees west 47.1 perches to a point; thence
14 still along the same north 28 degrees east 51 perches to a
15 point, the place of beginning, containing 15 acres, more or
16 less.
17 Excepting and reserving the coal underlying said tract of
18 land as previously excepted and reserved.
19 Being the same conveyed to the Commonwealth of Pennsylvania
20 by deed of Henriette Coal Mining Company dated May 18, 1929
21 recorded in the Office of the Recorder of Deeds for Cambria
22 County in Deed Book 398 at Page 446.
23 Section 2. Costs and fees incident to determining the actual
24 market value shall be borne by Longwall Mining, Incorporated.
25 Section 3. The Deed of Conveyance hereby contemplated shall
26 be executed by the Department of General Services in the name of
27 the Commonwealth of Pennsylvania after approval of it by the
28 Department of Justice.
29 Section 4. This act shall take effect immediately.
