AN ACT
1 Amending the act of April 9, 1929 (P.L.177, No.175), entitled
2 "An act providing for and reorganizing the conduct of the
3 executive and administrative work of the Commonwealth by the
4 Executive Department thereof and the administrative
5 departments, boards, commissions, and officers thereof,
6 including the boards of trustees of State Normal Schools, or
7 Teachers Colleges; abolishing, creating, reorganizing or
8 authorizing the reorganization of certain administrative
9 departments, boards, and commissions; defining the powers and
10 duties of the Governor and other executive and administrative
11 officers, and of the several administrative departments,
12 boards, commissions, and officers; fixing the salaries of the
13 Governor, Lieutenant Governor, and certain other executive
14 and administrative officers; providing for the appointment of
15 certain administrative officers, and of all deputies and
16 other assistants and employes in certain departments, boards,
17 and commissions; and prescribing the manner in which the
18 number and compensation of the deputies and all other
19 assistants and employes of certain departments, boards and
20 commissions shall be determined," providing for the
21 establishment and operation of a Sportsmen Advisory Council
22 to advise the Pennsylvania Fish and Boat Commission and the
23 Pennsylvania Game Commission.
24 The General Assembly of the Commonwealth of Pennsylvania
25 hereby enacts as follows:
26 Section 1. The introductory paragraph of section 448 of the
27 act of April 9, 1929 (P.L.177, No.175), known as The
1 Administrative Code of 1929, amended June 6, 1945 (P.L.1398,
2 No.446), is amended and the section is amended by adding a
3 clause to read:
4 Section 448. Advisory Boards and Commissions.--The advisory
5 boards and commissions, within the several administrative
6 departments and independent commissions, shall be constituted as
7 follows:

9 (q) (1) The Sportsmen Advisory Council shall consist of the
10 Executive Director of the Pennsylvania Fish and Boat Commission,
11 the Executive Director of the Pennsylvania Game Commission and a
12 representative from each of the following groups:
13 The Department of Environmental Resources Bureau of Forestry,
14 The Western Pennsylvania Conservatory,
15 The Unified Sportsmen of Pennsylvania,
16 The Pennsylvania Federation of Sportsmen's Clubs, Inc.,
17 The National Wild Turkey Federation - Pennsylvania Chapter,
18 The Pennsylvania Council of Trout Unlimited,
19 The Pennsylvania Trappers Association,
20 The Pennsylvania Bass Chapter Federation, Inc.,
21 The Pennsylvania Federation of Black Powder Shooters,
22 The Sierra Club,
23 The Pennsylvania Biological Survey,
24 The Pennsylvania Farmers Association FARM BUREAU, <--
25 The Pennsylvania Grange, <--
26 THE PENNSYLVANIA CHAPTER OF DUCKS UNLIMITED,
27 THE UNIFIED DISABLED SPORTSMEN,
28 THE UNITED BOW HUNTERS OF PENNSYLVANIA.
29 (2) The term of office of each appointed member shall be
30 three years, measured from the third Tuesday of January of the

1 year in which he takes office, or until his successor has been
2 appointed; except that in the initial appointments of the
3 members of the Sportsmen Advisory Council, the respective
4 appointing authorities shall appoint two members for terms of
5 one year each, two members for terms of two years each, and one
6 member for a term of three years.
7 (3) The Sportsmen Advisory Council shall include persons
8 knowledgeable in fields related to the work of the Pennsylvania
9 Fish and Boat Commission and the Pennsylvania Game Commission
10 such as, but not limited to, ecology, land management, water
11 pollution, boating, cold-water fisheries, warm-water fisheries, <--
12 game management, landowner relations, endangered and threatened
13 species, critical habitat and such other matters as may relate
14 to the operations of the Pennsylvania Fish and Boat Commission
15 or Pennsylvania Game Commission.
16 (4) The Sportsmen Advisory Council shall annually elect one
17 of its appointed members as chairman and shall elect a secretary
18 who need not be a member of the Sportsmen Advisory Council.
19 Meetings of the Sportsmen Advisory Council shall be held at
20 least quarterly or at the call of the chairman.
21 (5) The Sportsmen Advisory Council shall have power to
22 employ and fix the compensation of such experts, stenographers
23 and assistants as may be deemed necessary to carry out the work
24 of the Sportsmen Advisory Council, but due diligence shall be
25 exercised by the Sportsmen Advisory Council to enlist such
26 voluntary assistance as may be available from citizens, research
27 organizations, and other agencies in Pennsylvania or elsewhere,
28 generally recognized as qualified to aid the Sportsmen Advisory
29 Council. The expenses of the Sportsmen Advisory Council shall be
30 paid equally from the Fish Fund and the Game Fund.

1 (6) The Sportsmen Advisory Council shall review all hunting,
2 trapping, fishing and boating AND FISHING laws of this <--
3 Commonwealth and make appropriate suggestions for the revision,
4 modification and codification thereof.
5 (7) The Sportsmen Advisory Council shall consider, study and
6 review the work of the Pennsylvania Fish and Boat Commission and
7 the Pennsylvania Game Commission and for this purpose, the
8 Sportsmen Advisory Council shall have access to all books,
9 papers, documents and records pertaining or belonging to the
10 Pennsylvania Fish and Boat Commission or the Pennsylvania Game
11 Commission.
12 (8) The Sportsmen Advisory Council shall advise the
13 Pennsylvania Fish and Boat Commission and the Pennsylvania Game
14 Commission, on request, and shall make recommendations upon its
15 initiative for the improvement of the work of the Pennsylvania
16 Fish and Boat Commission and the Pennsylvania Game Commission.
17 Advice and recommendations made by the Sportsmen Advisory
18 Council shall not be binding upon the commissions.
19 (9) The Sportsmen Advisory Council shall report annually to
20 the Governor and to the General Assembly and may make such
21 interim reports as are deemed advisable.
22 Section 2. This act shall take effect in 60 days.
