                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further defining the offense of
     3     retaliation against witness or victim.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 4953 of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 4953.  Retaliation against witness or victim.
     9     (a)  Offense defined.--A person commits an offense if he
    10  harms, attempts to harm or threatens to harm another by any
    11  unlawful act in retaliation for anything lawfully done in the
    12  capacity of witness or victim.
    13     (b)  Grading.--The offense is a felony of the third degree if
    14  the retaliation is accomplished by any of the means specified in
    15  section 4952(b)(1) through (5) (relating to intimidation of
    16  witnesses or victims). Otherwise the offense is a misdemeanor of
    17  the second degree.
    18     Section 2.  This act shall take effect in 60 days.
