AN ACT 1 Amending Title 53 (Municipalities Generally) of the Pennsylvania 2 Consolidated Statutes, further providing for the prohibition <-- 3 on certain political activity and for the governing body of 4 the authorities; and providing local choice for fluoridation <-- 5 of public water THE AUTHORITIES. <-- 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. Section 2166.1 of Title 53 of the Pennsylvania <-- 9 Consolidated Statutes, amended December 30, 2002 (P.L.2001, 10 No.230), is amended to read: 11 [§ 2166.1. Prohibition on political activity. 12 A police officer as defined in section 2162 (relating to 13 definitions) who is subject to civil service under the 14 provisions of a statute, law or home rule charter and who is 15 certified under this subchapter may not engage or participate in 16 the conducting of any political or election campaign otherwise 17 than to exercise the police officer's own right of suffrage.] 18 Section 2. The Title is amended by adding a section to read:
1 § 2166.2. Prohibition on political activity. 2 (a) Prohibition on political activity.--Except as provided 3 in subsection (b), a police officer as defined in section 2162 4 (relating to definitions) who is subject to civil service under 5 the provisions of a statute, law or home rule charter and who is 6 certified under this subchapter may not engage or participate in 7 the conducting of any political or election campaign. 8 (b) Exception.--Notwithstanding the provisions of subsection 9 (a), a police officer may engage or participate in the 10 conducting of any political or election campaign under any of 11 the following: 12 (1) To exercise the police officer's own right of 13 suffrage. 14 (2) While the police officer is off duty and out of 15 uniform. 16 Section 3. Section 5508(b)(1) of Title 53 is amended to 17 read: 18 SECTION 1. SECTION 5508(B)(1) OF TITLE 53 OF THE <-- 19 PENNSYLVANIA CONSOLIDATED STATUTES IS AMENDED TO READ: 20 § 5508. Governing body. 21 * * * 22 (b) Board.-- 23 (1) The powers of an authority shall be exercised by a 24 board composed of five members. The majority of the members 25 must be residents of the municipality where the authority is 26 located. [All members] Each member must be [residents] a 27 resident of the county in which the municipality is located 28 or maintain a business in the municipality served by the 29 authority. 30 * * * 20030H1785B3018 - 2 -
1 Section 4. Title 53 is amended by adding a chapter to read: <-- 2 CHAPTER 57-A 3 FLUORIDATION OF PUBLIC WATER 4 Sec. 5 5701-A. Scope. 6 5702-A. Purpose. 7 5703-A. Local fluoridation option. 8 5704-A. Notification. 9 § 5701-A. Scope. 10 This chapter relates to Fluoridation of Public Water. 11 § 5702-A. Purpose. 12 It is the purpose of this chapter to allow municipalities and 13 public water authorities the option of removing fluoride or 14 fluoridation systems from public water supplies in this 15 Commonwealth. 16 § 5703-A. Local fluoridation option. 17 Notwithstanding any other law, a municipality or public water 18 authority may remove an existing water fluoridation system from 19 a public water system. 20 § 5704-A. Notification. 21 At least 60 days prior to taking action, a municipality or 22 public water authority which intends to cease adding fluoride to 23 a public water supply must communicate its intent in writing to 24 all customers served by that water supply and to the Department 25 of Environmental Protection. The municipality or public water 26 authority shall hold a public hearing on the proposal within 30 27 days after notifying the public. 28 Section 5 2.
