AN ACT
1 Amending Title 23 (Domestic Relations) of the Pennsylvania
2 Consolidated Statutes, further providing for contempt for
3 noncompliance with visitation or partial custody order.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 4346 of Title 23 of the Pennsylvania
7 Consolidated Statutes is amended to read:
8 § 4346. Contempt for noncompliance with visitation or partial
9 custody order.
10 (a) General rule.--A party who willfully fails to comply
11 with any visitation or partial custody order may, as prescribed
12 by general rule, be adjudged in contempt. Contempt shall be
13 punishable by any one or more of the following:
14 (1) Imprisonment for a period not to exceed six months.
15 (2) A fine not to exceed $500.
16 (3) Probation for a period not to exceed six months.
17 (4) Modification of a support order under this chapter.
18 (b) Condition for release.--An order committing a person to
1 jail under this section shall specify the condition which, when
2 fulfilled, will result in the release of the obligor.
3 Section 2. This act shall apply to contempt actions which
4 are based upon acts committed on or after the effective date of
5 this act.
6 Section 3. This act shall take effect in 60 days.
