                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, prohibiting the manufacture and sale
     3     of replicas of firearms.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 18 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 6163.  Manufacture or sale of replicas of firearms.
     9     (a)  Manufacture prohibited.--A person commits a misdemeanor
    10  of the third degree if he manufactures a replica of a firearm.
    11     (b)  Sale prohibited.--A person commits a summary offense if
    12  he sells a replica of a firearm.
    13     (c)  Definition.--As used in this section, the term "replica
    14  of a firearm" means a toy or other thing which, to the casual
    15  observer, looks like a firearm, regardless of whether it is a
    16  close copy of any particular type, make or model, unless it is
    17  of a bright red, orange or yellow color and the color is an


     1  integral part of the material of which the replica is
     2  constructed and not merely applied to its surface.
     3     Section 2.  (a)  With respect to a manufacturer of toy
     4  pistols, this act shall apply to all toy pistols manufactured
     5  six months after the effective date of this section.
     6     (b)  With respect to a seller of toy pistols, this act shall
     7  apply to all toy pistol inventory purchased from a manufacturer
     8  or wholesaler on or after the effective date when it becomes
     9  unlawful to manufacture said toy pistol, but shall not apply to
    10  toy pistol inventory purchased prior to such date.
    11     Section 3.  This act shall take effect in 60 days.
