AN ACT 1 Authorizing the Department of Property and Supplies, with the 2 approval of the Governor and the Department of Environmental 3 Resources, to convey a tract of land in Lower Yoder Township, 4 Cambria County, in exchange for another tract located in the 5 same township. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. The Department of Property and Supplies, with the 9 approval of the Governor and the Department of Environmental 10 Resources, is hereby authorized to convey to the Piney Run 11 Mining Company the following described tract number 1 in 12 exchange for tracks numbers 2 and 3 located in Lower Yoder 13 Township, Cambria County, Commonwealth of Pennsylvania, bounded 14 and described as follows: 15 Tract No. 1 16 Beginning at a point at a corner of the Potts and Bheam, Alex 17 Stackhouse and Frederick Brehm tract; thence north 56 degrees 27 18 minutes west 2007.3 feet, to a point on the line of the J. P. 19 McConnaughy Estate tract; thence by the line of the J. P.
1 McConnaughy Estate tract north 35 degrees 35 minutes east 1400 2 feet thence through the Potts and Bheam tract of which this is a 3 part, south 56 degrees 27 minutes east 2007.3 feet to a point on 4 the line of the Alex Stackhouse tract; thence by the line of the 5 Alex Stackhouse tract south 34 degrees 49 minutes west 1400 feet 6 to the place of beginning. Containing 65 acres, more or less. 7 Title to which became vested in the Commonwealth of 8 Pennsylvania by deed of the Western Pennsylvania Conservancy 9 recorded in Cambria County Deed Book Volume 866, Page 72. 10 Tract No. 2 11 Beginning at Stones at the corner of the David Gates tract 12 and Frederick Brehm tract and the J. P. McConnaughy Estate 13 tract; thence by line of the J. P. McConnaughy Estate tract 14 north 34 degrees 43 minutes east 4390 feet to a point and north 15 35 degrees 35 minutes east 115.5 feet to a point on the line of 16 the Potts and Bheam tract; thence by the Potts and Bheam tract 17 south 56 degrees 27 minutes east 750 feet to a point; thence 18 through the Frederick Brehm tract of which this formerly was a 19 part, south 34 degrees 43 minutes west 4505.5 feet to a point on 20 line of the David Gates tract; thence by line of the David Gates 21 tract north 56 degrees 27 minutes west 750 feet to Stones and 22 place of beginning. Containing 75 acres. Except and reserving 23 all the minerals and oil and gas underlying said land, together 24 with all rights necessary or convenient for the removal or 25 mining of said minerals and oil and gas. 26 Being a part of a larger tract of land conveyed to the Piney 27 Run Mining Company by deed of W. David Lloyd, dated September 28 13, 1917 and recorded in Cambria County Deed Book Volume 292, 29 Page 608. 30 Tract No. 3 19750H1752B2222 - 2 -
1 Beginning at Stones at the corner of the Edward Lewis tract, 2 Alex Stackhouse tract and Potts and Bheam tract thence by the 3 Potts and Bheam tract north 33 degrees 50 minutes east 2611.5 4 feet to a post on line of the George Bumbernick tract; thence by 5 the George Bumbernick tract south 54 degrees 8 minutes east 6 377.8 feet to a point; then through the Edward Lewis tract, of 7 which this was formerly a part south 33 degrees 50 minutes west 8 2611.5 feet to a point on the line of the Alex Stackhouse tract; 9 thence by the Alex Stackhouse tract north 55 degrees 27 minutes 10 west 377.8 feet to stones in the place of beginning. Containing 11 22 acres. Except and reserving all the minerals and oil and gas 12 underlying said land, together with all rights necessary or 13 convenient for the removal or mining of said minerals and oil 14 and gas. 15 Being a part of a larger tract of land conveyed to the Piney 16 Run Mining Company by deed of W. David Lloyd, dated September 17 13, 1917 and recorded in Cambria County Deed Book Volume 292, 18 Page 608. 19 Section 2. The deed of conveyance by the Commonwealth shall 20 be approved by the Department of Justice and shall be executed 21 by the Secretary of Property and Supplies in the name of the 22 Commonwealth of Pennsylvania.
