                                     AN ACT

     1  Amending the act of May 20, 1949 (P.L.1633, No.493), entitled,
     2     as reenacted and amended, "An act providing and regulating
     3     State assistance for housing and redevelopment, including
     4     comprehensive programs for the development of entire sections
     5     or neighborhoods; and making an appropriation," further
     6     providing for grant authorizations.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 4 of the act of May 20, 1949 (P.L.1633,
    10  No.493), known as the Housing and Redevelopment Assistance Law,
    11  reenacted and amended April 12, 1956 (1955 P.L.1449, No.477) and
    12  amended December 16, 1968 (P.L.1219, No.385), is amended to
    13  read:
    14     Section 4.  Grant Authorization.--The department is hereby
    15  authorized, within the limitations hereinafter provided, (a) to
    16  make capital grants in the furtherance of housing development
    17  and to assist the construction and operating of housing projects
    18  through the payment of such grants by contracting with
    19  governmental agencies or authorities such as housing authorities


     1  and urban redevelopment authorities, or with limited dividend
     2  housing corporations, insurance companies, or any other private,
     3  public or semi-public agencies, firms or corporations providing
     4  adequate surety, acceptable to the department, guaranteeing
     5  continuity of operation throughout the term of its contract, and
     6  (b) to make capital grants to redevelopment authorities in the
     7  furtherance of redevelopment, (c) to make capital grants to
     8  municipalities [or to], redevelopment authorities or nonprofit
     9  corporations for the prevention and elimination of blight, and
    10  (d) to make capital grants to governmental agencies or
    11  authorities, or nonprofit corporations for the purpose of
    12  providing funds, which would be otherwise unavailable to
    13  initiate, apply for, administer, and execute housing projects
    14  financed under any Federal housing program, said housing
    15  projects to be built and operated in accordance with Federal law
    16  and regulations and shall not be bound by the conditions
    17  attached to housing projects pursuant to section 4 (a), and said
    18  grant shall not exceed ten per cent of the total cost of a
    19  proposed project, and (e) to make capital grants to governmental
    20  agencies or authorities, or nonprofit corporations for the
    21  purpose of acquiring single family dwelling units which are in a
    22  state of disrepair, and to rehabilitate said dwelling units and
    23  to sell these dwelling units to persons or families whose income
    24  is not higher than the highest annual income level in the lower
    25  or middle third of nonfarm family incomes, and whose financial
    26  resources would be insufficient to purchase said dwelling unit
    27  after rehabilitation without the assistance provided by this
    28  act, purchaser's income to be considered insufficient in cases
    29  where more than twenty per cent of said income would be required
    30  for debt service to liquidate the mortgage; the resale price for

     1  the rehabilitated dwelling unit shall not be less than the cost
     2  of initial acquisition, nor more than the cost of acquisition
     3  and rehabilitation; programs under this subsection 4 (e) shall
     4  not be bound by the conditions attached to housing projects
     5  produced under subsection 4 (a), and (f) to cooperate with and
     6  make exchanges of the use of personnel, or funds with other
     7  departments, agencies, or instrumentalities of the Commonwealth
     8  in the execution of housing functions delegated to said
     9  departments, agencies, or instrumentalities by the General
    10  Assembly.
    11     There shall be no discrimination against any person because
    12  of race, color, religion or national origin in the rental or
    13  occupancy of any housing constructed under the provisions of
    14  this act.
    15     Section 2.  This act shall take effect in 60 days.
