                                     AN ACT

     1  Establishing a College Education Tuition Waiver Program for
     2     spouses and dependent children of deceased and severely
     3     wounded victims of the September 11, 2001, terrorist attacks.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6  Section 1.  Establishment of program.
     7     The Pennsylvania Higher Education Assistance Agency (PHEAA)
     8  is hereby authorized and encouraged to administer a College
     9  Education Tuition Waiver Program for spouses and dependent
    10  children of deceased and severely wounded victims of the
    11  September 11, 2001, terrorist attacks.
    12  Section 2.  Requirements.
    13     (a)  Dependence on victim.--The College Education Tuition
    14  Waiver Program shall be available to spouses and dependent
    15  children, including natural, adopted and stepchildren, who were
    16  financially dependent on deceased and severely wounded victims
    17  of 9/11 terrorist attacks.

     1     (b)  Residence.--The victim must have been a Pennsylvania
     2  resident on September 11, 2001. A spouse or dependent child must
     3  be a current Pennsylvania resident. A spouse or child attending
     4  college out of State shall qualify as a current Pennsylvania
     5  resident.
     6  Section 3.  Limitations.
     7     (a)  Studies.--The College Education Tuition Waiver Program
     8  covers only undergraduate studies.
     9     (b)  Years of study.--The College Education Tuition Waiver
    10  Program is limited to four years of study. Years need not be
    11  consecutive.
    12     (c)  Admission requirements.--Recipients must meet an
    13  institution's standard admission requirements.
    14     (d)  Transfer.--Waivers are nontransferable.
    15  Section 4.  Additional information.
    16     The College Education Tuition Waiver Program may be used for:
    17         (1)  Tuition, room, board and mandated fees.
    18         (2)  Degree or certificate programs.
    19         (3)  Community colleges, Penn College of Technology,
    20     State System of Higher Education (SSHE) universities and
    21     State-related universities.
    22  Section 5.  Registration.
    23     (a)  Persons who intend to request tuition waiver.--Within
    24  five years of enactment of this act, persons who intend to
    25  request a college education tuition waiver are required to
    26  register their intent with the PHEAA. Registration does not
    27  obligate the registrant to attend any college.
    28     (b)  Persons who do not intend to request tuition waiver.--
    29  Persons who are eligible but do not wish to participate are also
    30  requested to notify the PHEAA of their decision.

     1  Section 6.  Effective date.
     2     This act shall take effect in 60 days.
