AN ACT 1 Amending the act of April 9, 1929 (P.L.177, No.175), entitled 2 "An act providing for and reorganizing the conduct of the 3 executive and administrative work of the Commonwealth by the 4 Executive Department thereof and the administrative 5 departments, boards, commissions, and officers thereof, 6 including the boards of trustees of State Normal Schools, or 7 Teachers Colleges; abolishing, creating, reorganizing or 8 authorizing the reorganization of certain administrative 9 departments, boards, and commissions; defining the powers and 10 duties of the Governor and other executive and administrative 11 officers, and of the several administrative departments, 12 boards, commissions, and officers; fixing the salaries of the 13 Governor, Lieutenant Governor, and certain other executive 14 and administrative officers; providing for the appointment of 15 certain administrative officers, and of all deputies and 16 other assistants and employes in certain departments, boards, 17 and commissions; and prescribing the manner in which the 18 number and compensation of the deputies and all other 19 assistants and employes of certain departments, boards and 20 commissions shall be determined," changing the status of the 21 Pennsylvania Securities Commission. 22 The General Assembly of the Commonwealth of Pennsylvania 23 hereby enacts as follows: 24 Section 1. Section 201, act of April 9, 1929 (P.L.177, 25 No.175), known as "The Administrative Code of 1929," amended 26 December 3, 1970 (P.L.834, No.275), is amended to read: 27 Section 201. Executive Officers, Administrative Departments
1 and Independent Administrative Boards and Commissions.--The 2 executive and administrative work of this Commonwealth shall be 3 performed by the Executive Department, consisting of the 4 Governor, Lieutenant Governor, Secretary of the Commonwealth, 5 Attorney General, Auditor General, State Treasurer, and 6 Superintendent of Public Instruction; by the Executive Board, 7 and the Pennsylvania State Police; by the following 8 administrative departments: Department of State, Department of 9 Justice, Department of the Auditor General, Treasury Department, 10 Department of Public Instruction, Department of Military 11 Affairs, Insurance Department, Department of Banking, Department 12 of Agriculture, Department of Transportation, Department of 13 Health, Department of Labor and Industry, Department of Public 14 Welfare, Department of Property and Supplies, Department of 15 Revenue, Department of Commerce, Department of Community Affairs 16 and Department of Environmental Resources; and by the following 17 independent administrative boards and commissions: Pennsylvania 18 Game Commission, Pennsylvania Fish Commission, State Civil 19 Service Commission, Pennsylvania Public Utility Commission, 20 [and] the Pennsylvania Historical and Museum Commission and the 21 Pennsylvania Securities Commission. 22 All of the provisions of this act, which apply generally to 23 administrative departments, or generally except to the 24 Department of the Auditor General and the Treasury Department, 25 shall apply to the Executive Board and to the Pennsylvania State 26 Police. 27 Section 2. As much as applies to the Pennsylvania Securities 28 Commission in the Department of Banking of section 202 of the 29 act, amended May 25, 1945 (P.L.1015, No.389) and June 6, 1945 30 (P.L.1398, No.446), is amended to read: 19750H1569B1900 - 2 -
1 Section 202. Departmental Administrative Boards, 2 Commissions, and Offices.--The following boards, commissions, 3 and offices are hereby placed and made departmental 4 administrative boards, commissions, or offices, as the case may 5 be, in the respective administrative departments mentioned in 6 the preceding section, as follows: 7 * * * 8 In the Department of Banking, 9 Board to License Private Bankers; 10 [Pennsylvania Securities Commission;] 11 * * * 12 All of the foregoing departmental administrative boards and 13 commissions shall be organized or reorganized as provided in 14 this act. 15 Section 3. The act is amended by adding a section to read: 16 Section 305. Pennsylvania Securities Commission.--The 17 chairman of the commission shall receive a salary at the rate of 18 thirteen thousand dollars ($13,000) per annum. The other members 19 of the commission shall receive salaries at the rate of twelve 20 thousand dollars ($12,000) per annum. 21 Section 4. Section 429 of the act, amended January 14, 1952 22 (P.L.1945, No.545), is repealed. 23 Section 5. Section 1605 of the act, amended June 6, 1939 24 (P.L.250, No.144), is repealed. 25 Section 6. The act is amended by adding an article to read: 26 ARTICLE XXVII-B 27 Powers and Duties of the Pennsylvania Securities Commission 28 Section 2701-B. Pennsylvania Securities Commission.--The 29 Pennsylvania Securities Commission shall continue to exercise 30 the powers and perform the duties vested in and imposed upon 19750H1569B1900 - 3 -
