AN ACT
1 Amending Title 42 (Judiciary and Judicial Procedure) of the
2 Pennsylvania Consolidated Statutes, further providing
3 exclusions from exemptions from process.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 8127 of Title 42 of the Pennsylvania
7 Consolidated Statutes is amended to read:
8 § 8127. Personal earnings exempt from process.
9 (A) EXEMPTION.-- The wages, salaries and commissions of <--
10 individuals shall while in the hands of the employer be exempt
11 from any attachment, execution or other process except upon an
12 action or proceeding:
13 (1) For support.
14 (2) For board [for four weeks or less] or rent for
15 residential purposes for which the court may attach no more
16 than 10% of the wages of the judgment debtor.
17 (3) Under the act of August 7, 1963 (P.L.549, No.290),
1 referred to as the Pennsylvania Higher Education Assistance
2 Agency Act.
3 (B) SUPPORT ORDER.--AN ORDER OF ATTACHMENT FOR SUPPORT SHALL <--
4 HAVE PRIORITY OVER ANY ATTACHMENT, EXECUTION, GARNISHMENT OR
5 WAGE ASSIGNMENT.
6 Section 2. This act shall take effect in 60 days.
