| AN ACT |
| |
1 | Amending Title 18 (Crimes and Offenses) of the Pennsylvania |
2 | Consolidated Statutes, making an editorial change; and |
3 | further providing for contraband. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. The heading of Subchapter B of Chapter 51 of |
7 | Title 18 of the Pennsylvania Consolidated Statutes is amended to |
8 | read: |
9 | SUBCHAPTER B |
10 | ESCAPE AND CONTRABAND |
11 | Section 2. Section 5123(c) of Title 18 is amended to read: |
12 | § 5123. Contraband. |

14 | (c) Contraband other than controlled substance.--A person |
15 | commits a misdemeanor of the first degree if he sells, gives or |
16 | furnishes to any convict in a prison, or inmate in a mental |
17 | hospital, or gives away in or brings into any prison, mental |

1 | hospital, or any building appurtenant thereto, or on the land |
2 | granted to or owned or leased by the Commonwealth or county for |
3 | the use and benefit of the prisoners or inmates, or puts in any |
4 | place where it may be secured by a convict of a prison, inmate |
5 | of a mental hospital, or employee thereof, any of the following: |
6 | (1) Any kind of spirituous or fermented liquor, medicine |
7 | or poison (except the ordinary hospital supply of the prison |
8 | or mental hospital) without a written permit signed by the |
9 | physician of such institution, specifying the quantity and |
10 | quality of the substance which may be furnished to any |
11 | convict, inmate or employee in the prison or mental hospital, |
12 | the name of the prisoner, inmate or employee for whom, and |
13 | the time when the same may be furnished, which permit shall |
14 | be delivered to and kept by the warden or superintendent of |
15 | the prison or mental hospital. |
16 | (2) Any item designated by the Secretary of Corrections |
17 | or the facility manager as a prohibited item. |

19 | Section 3. This act shall take effect in 60 days. |
