AN ACT
1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2 Consolidated Statutes, further providing for the possession
3 and dissemination of photographs and films of prohibited
4 sexual acts of a child under the age of 16 years.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Section 6312(c) of Title 18 of the Pennsylvania
8 Consolidated Statutes is amended to read:
9 § 6312. Sexual abuse of children.

11 (c) Dissemination of photographs and films.--Any person who
12 sells, displays for sale or transfer, or who possesses for the
13 purpose of sale, display for sale or transfer, any book,
14 magazine, pamphlet, slide, photograph or film depicting a child
15 under the age of 16 years engaging in a prohibited sexual act or
16 in the simulation of such act is guilty of a felony of the third
17 degree. Possession of three or more copies of the book,
18 magazine, pamphlet, slide, photograph or film is an inference of
1 possession with intent to disseminate.

3 Section 2. This act shall take effect in 90 days.
