1Amending Title 42 (Judiciary and Judicial Procedure) of the
2Pennsylvania Consolidated Statutes, in registration of sexual
3offenders, further providing for sexual offenses and tier
4system.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Section 9799.14(d) of Title 42 of the
8Pennsylvania Consolidated Statutes is amended to read:

9§ 9799.14. Sexual offenses and tier system.

11(d) Tier III sexual offenses.--The following offenses shall
12be classified as Tier III sexual offenses:

13(1) 18 Pa.C.S. § 2502 (relating to murder), when 
14committed for the purpose, in whole or substantial part, of 
15direct sexual stimulation or gratification.

16(1.1) 18 Pa.C.S. § 2503 (relating to voluntary 
17manslaughter), when committed for the purpose, in whole or 
18substantial part, of direct sexual stimulation or
 

1gratification.

2(1.2) 18 Pa.C.S. § 2702 (relating to aggravated 
3assault), when committed for the purpose, in whole or 
4substantial part, of direct sexual stimulation or 
5gratification.

6(1.3) 18 Pa.C.S. § 2709.1(c)(2) (relating to stalking), 
7when committed for the purpose, in whole or substantial part, 
8of direct sexual stimulation or gratification.

9(1.4) 18 Pa.C.S. § 2901(a.1) (relating to kidnapping).

10(2) 18 Pa.C.S. § 3121 (relating to rape).

11(3) 18 Pa.C.S. § 3122.1(b) (relating to statutory sexual
12assault).

13(4) 18 Pa.C.S. § 3123 (relating to involuntary deviate
14sexual intercourse).

15(5) 18 Pa.C.S. § 3124.1 (relating to sexual assault).

16(6) 18 Pa.C.S. § 3124.2(a.1).

17(7) 18 Pa.C.S. § 3125 (relating to aggravated indecent
18assault).

19(8) 18 Pa.C.S. § 3126(a)(7).

20(8.1) 18 Pa.C.S. § 3301 (relating to arson and related
21offenses), when committed for the purpose, in whole or
22substantial part, of direct sexual stimulation or
23gratification.

24(8.2) 18 Pa.C.S. § 3502 (relating to burglary), when
25committed for the purpose, in whole or substantial part, of
26direct sexual stimulation or gratification.

27(8.3) 18 Pa.C.S. § 3701 (relating to robbery), when
28committed for the purpose, in whole or substantial part, of
29direct sexual stimulation or gratification.

30(9) 18 Pa.C.S. § 4302(b) (relating to incest).

1(10) 18 U.S.C. § 2241 (relating to aggravated sexual
2abuse).

3(11) 18 U.S.C. § 2242 (relating to sexual abuse).

4(12) 18 U.S.C. § 2244 where the victim is under 13 years 
5of age.

6(13) A comparable military offense or similar offense
7under the laws of another jurisdiction or country or under a
8former law of this Commonwealth.

9(14) An attempt, conspiracy or solicitation to commit an
10offense listed in paragraph (1), (1.1), (1.2), (1.3), (1.4),
11(2), (3), (4), (5), (6), (7), (8), (8.1), (8.2), (8.3), (9),
12(10), (11), (12) or (13).

13(15) (Reserved).

14(16) Two or more convictions of offenses listed as Tier
15I or Tier II sexual offenses.

16Section 2. This act shall take effect in 60 days.
