                                     AN ACT

     1  Amending the act of July 28, 1988 (P.L.556, No.101), entitled
     2     "An act providing for planning for the processing and
     3     disposal of municipal waste; requiring counties to submit
     4     plans for municipal waste management systems within their
     5     boundaries; authorizing grants to counties and municipalities
     6     for planning, resource recovery and recycling; imposing and
     7     collecting fees; establishing certain rights for host
     8     municipalities; requiring municipalities to implement
     9     recycling programs; requiring Commonwealth agencies to
    10     procure recycled materials; imposing duties; granting powers
    11     to counties and municipalities; authorizing the Environmental
    12     Quality Board to adopt regulations; authorizing the
    13     Department of Environmental Resources to implement this act;
    14     providing remedies; prescribing penalties; establishing a
    15     fund; and making repeals," requiring the purchase of
    16     postconsumer office paper products by the Department of
    17     General Services, Commonwealth agencies, political
    18     subdivisions and local school districts.

    19     The General Assembly of the Commonwealth of Pennsylvania
    20  hereby enacts as follows:
    21     Section 1.  Section 1508(a) of the act of July 28, 1988
    22  (P.L.556, No.101), known as the Municipal Waste Planning,
    23  Recycling and Waste Reduction Act, is amended to read:
    24  Section 1508.  Procurement options for local public agencies and


     1                 certain Commonwealth agencies.
     2     (a)  General rule.--[This section sets forth procurement
     3  options for local public agencies. These procurement options are
     4  also available to Commonwealth agencies other than the
     5  Department of General Services.] Except for the requirements
     6  provided in section 1511.1, the following procurement options
     7  are also available to Commonwealth agencies other than the
     8  Department of General Services.

    10     Section 2.  The act is amended by adding a section to read:
    11  Section 1511.1.  Purchase of postconsumer office paper products
    12                 by Commonwealth agencies, political subdivisions
    13                 and local school districts.
    14     (a)  General rule.--In addition to all other requirements
    15  imposed by this act, the Department of General Services and all
    16  Commonwealth agencies, political subdivisions and local school
    17  districts shall, to the fullest extent possible, purchase or
    18  approve for purchase only such office paper, paper products and
    19  printing that are manufactured or produced from postconsumer
    20  recycled paper as specified in subsection (b).
    21     (b)  Implementation.--The provisions of subsection (a) shall
    22  be implemented by the Department of General Services,
    23  Commonwealth agencies, political subdivisions and local school
    24  districts so that of the total volume of paper and printing
    25  purchased, postconsumer recycled paper composes at least 25% of
    26  the volume in 1992, at least 50% of the volume in 1994, and at
    27  least 75% of the volume in 1996.
    28     (c)  Application.--This act shall not apply to the purchase
    29  of paper containers for food or beverages.
    30     (d)  Definitions.--As used in this section, the following

     1  words and phrases shall have the meanings given to them in this
     2  subsection:
     3     "Office paper."  Any writing, typing, stationery,
     4  photocopying, computer, calculator or other paper customarily
     5  used for general office work.
     6     "Postconsumer recycled office paper."  Any office paper
     7  product manufactured from paper materials generated by a
     8  business or consumer which has served its intended end use and
     9  which has been separated from other solid waste for the purposes
    10  of collection, recycling and disposition and which does not
    11  include secondary waste material or demolition waste.
    12     Section 3.  This act shall take effect immediately.
