           STABACK, THOMAS, TIGUE, WALKO, WHEATLEY, WOJNAROSKI AND

                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for obstruction of
     3     law or government.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 5101 of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 5101.  Obstructing administration of law or other governmental
     9             function.
    10     [A] (a)  General rule.--Except as set forth in subsection
    11  (b), a person commits a misdemeanor of the second degree if he
    12  intentionally [obstructs,] does any of the following:
    13         (1)  Obstructs, impairs or perverts the administration of
    14     law or other governmental function by force, violence,
    15     physical interference or obstacle, breach of official duty,
    16     or any other unlawful act[, except that this].


     1         (2)  Intimidates an individual to refrain from informing,
     2     reporting to or cooperating with an agency of the
     3     Commonwealth or of a political subdivision.
     4     (b)  Exception.--This section does not apply to flight by a
     5  person charged with crime, refusal to submit to arrest, failure
     6  to perform a legal duty other than an official duty, or any
     7  other means of avoiding compliance with law without affirmative
     8  interference with governmental functions.
     9     Section 2.  This act shall take effect in 60 days.
