AN ACT
1 Amending the act of April 9, 1929 (P.L.177, No.175), entitled
2 "An act providing for and reorganizing the conduct of the
3 executive and administrative work of the Commonwealth by the
4 Executive Department thereof and the administrative
5 departments, boards, commissions, and officers thereof,
6 including the boards of trustees of State Normal Schools, or
7 Teachers Colleges; abolishing, creating, reorganizing or
8 authorizing the reorganization of certain administrative
9 departments, boards, and commissions; defining the powers and
10 duties of the Governor and other executive and administrative
11 officers, and of the several administrative departments,
12 boards, commissions, and officers; fixing the salaries of the
13 Governor, Lieutenant Governor, and certain other executive
14 and administrative officers; providing for the appointment of
15 certain administrative officers, and of all deputies and
16 other assistants and employes in certain departments, boards,
17 and commissions; and prescribing the manner in which the
18 number and compensation of the deputies and all other
19 assistants and employes of certain departments, boards and
20 commissions shall be determined," requiring gender balance
21 for State board and commission appointments.
22 The General Assembly of the Commonwealth of Pennsylvania
23 hereby enacts as follows:
24 Section 1. The act of April 9, 1929 (P.L.177, No.175), known
25 as The Administrative Code of 1929, is amended by adding a
26 section to read:
27 Section 224. Gender Balance on State Boards and Commissions
1 Declaration of Policy.--The General Assembly finds and declares 2 as follows: The appointive State boards and commissions have an 3 important role in the public policymaking of this Commonwealth 4 and should reflect the diversity of this Commonwealth's 5 population in order to take advantage of the valuable knowledge, 6 experience and expertise of its citizenry. Although the most 7 qualified individuals should be sought and appointed to serve, 8 the General Assembly finds that gender balance is also an 9 appropriate and desirable factor to consider in achieving truly 10 representative membership. 11 (a) Except as otherwise provided by law, appointments to 12 State boards and commissions shall be made in a manner that the 13 cumulative number of members serving represent, to the extent 14 possible, equal numbers of women and men by the year 1996. 15 (b) Nothing in this subsection shall prohibit an individual 16 from completing a term being served at the time this act becomes 17 effective. 18 (c) The Pennsylvania Commission for Women shall be 19 responsible for developing a Statewide roster of qualified women 20 for appointment to State boards and commissions, maintaining 21 complete and accurate records on the composition of all boards 22 and commissions and appointments made thereto, and submitting an 23 annual report by January 31 of each year to the General Assembly 24 concerning compliance with this act. 25 Section 2.
