AN ACT 1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An 2 act relating to the public school system, including certain 3 provisions applicable as well to private and parochial 4 schools; amending, revising, consolidating and changing the 5 laws relating thereto," further providing for notice 6 publication by recognizing the Internet and for emergency 7 certification to overcome teacher shortages. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. Section 106 of the act of March 10, 1949 (P.L.30, 11 No.14), known as the Public School Code of 1949, is amended by 12 adding a subsection to read: 13 Section 106. Publication of Notices, etc.; Proofs of 14 Publication.--* * * 15 (d) (1) When so permitted by statute, publication of a 16 notice may be made on the Department of Education's Internet 17 website or on the Internet website of a publishing school 18 district. Proof of such publication shall be provided as
1 prescribed by regulation. 2 (2) This subsection shall not apply to a notice that is 3 required to be published in the Pennsylvania Bulletin. 4 Section 2. Section 1109.1 of the act, added June 7, 1993 5 (P.L.49, No.16), is amended to read: 6 Section 1109.1. Emergency Certification in Certain 7 Instances.--(a) When the superintendent and board of education 8 of a school district of the first class find that the supply of 9 certified teachers is inadequate to the educational needs of the 10 district's language minority student population or that the loss 11 of teachers due to early retirement would cause the interruption 12 of suitable and essential programs of instruction for such 13 students, the district may, with the permission of the 14 Department of Education, hire otherwise qualified persons 15 without current teaching certificates, provided that individuals 16 so employed shall enroll in a teacher certification program and 17 meet Pennsylvania certification requirements within a period not 18 to exceed three (3) years. 19 (b) If a school district OF ANY CLASS applies to the <-- 20 Department of Education for an emergency permit in order to 21 employ an individual to teach, the Department of Education shall 22 post this information on its Internet website for a minimum of 23 thirty (30) days using an easy-to-find and easy-to-read format 24 in order to provide this information to the public generally and 25 to prospective candidates for the available teaching position 26 specifically. 27 (c) An emergency certificate issued under this section may 28 be renewed for the employed individual should no certified AND <-- 29 FULLY QUALIFIED teacher be employable. AN INDIVIDUAL SO EMPLOYED <-- 30 SHALL ENROLL IN A TEACHER CERTIFICATION PROGRAM AND MEET 20050H1252B4215 - 2 -
1 PENNSYLVANIA CERTIFICATION REQUIREMENTS WITHIN A PERIOD NOT TO 2 EXCEED THREE (3) YEARS FROM THE DATE THE PERSON WAS ORIGINALLY 3 HIRED UNDER SUBSECTION (A). 4 Section 3. This act shall take effect in 60 days. A20L24DMS/20050H1252B4215 - 3 -
