AN ACT

 

1Amending Title 34 (Game) of the Pennsylvania Consolidated
2Statutes, further providing for unlawful devices and methods.

3The General Assembly of the Commonwealth of Pennsylvania
4hereby enacts as follows:

5Section 1. Section 2308(a)(7) and (8) of Title 34 of the
6Pennsylvania Consolidated Statutes are amended to read:

7§ 2308. Unlawful devices and methods.

8(a) General rule.--Except as otherwise provided in this
9title, it is unlawful for any person to hunt or aid, abet,
10assist or conspire to hunt any game or wildlife through the use
11of:

13(7) A vehicle or conveyance of any kind or its
14attachment propelled by other than manpower. Nothing [in this
15subsection] under this paragraph shall pertain to any
16motorboat or sailboat if the motor has been completely shut
17off or sail furled, and the progress thereof has ceased. A 
18person may not, when using a vehicle or conveyance under this 

1paragraph, take big game on the property of another without 
2lawful permission from the owner of the property.

3(8) Any artificial or natural bait, hay, grain, fruit,
4nut, salt, chemical, mineral or other food as an enticement
5for game or wildlife, regardless of kind and quantity, or
6take advantage of any such area or food or bait prior to 30
7days after the removal of such material and its residue.
8Nothing [contained in this subsection] under this paragraph
9shall pertain to normal or accepted farming, habitat
10management practices, oil and gas drilling, mining, forest
11management activities or other legitimate commercial or
12industrial practices. Upon discovery of such baited areas,
13whether prosecution is contemplated or not, the commission
14may cause a reasonable area surrounding the enticement to be
15posted against hunting or taking game or wildlife. The
16posters shall remain for 30 days after complete removal of
17the bait.

19Section 2. This act shall take effect in 60 days.
