AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in pupils and attendance, providing
for attendance at intermediate units.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of March 10, 1949 (P.L.30, No.14), known
as the Public School Code of 1949, is amended by adding a
section to read:
Section 1327.4. Attendance at Intermediate Units.--(a) An
intermediate unit shall establish an attendance policy designed
to accurately determine attendance for a child who is enrolled
in a school district and receives a portion of the child's
education from the intermediate unit.
(b) The policy under subsection (a) shall address how the
intermediate unit:
(1) coordinates procedures with the school district when a
child is truant under section 1333;

(2) participates in the school attendance improvement
conference under section 1333(b); and
(3) coordinates procedures with the school district when a
child is habitually truant under section 1333.1.
(c) If an intermediate unit provides all or substantially
all of a student's education, the intermediate unit shall be
responsible for all truancy procedures under sections 1333.1 and
1333.
(d) If an intermediate unit provides all or substantially
all of a student's education under a contract with a school
district, the contract shall include the manner in which funding
shall be required if the student is habitually truant under
section 1333.1.
Section 2. This act shall take effect in 60 days.
