AN ACT 1 Amending Title 4 (Amusements) of the Pennsylvania Consolidated 2 Statutes, defining "annuity jackpot"; and providing for 3 reporting to the Department of Revenue of annuity jackpot 4 winners. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Section 1103 of Title 4 of the Pennsylvania 8 Consolidated Statutes is amended by adding a definition to read: 9 § 1103. Definitions. 10 The following words and phrases when used in this part shall 11 have the meanings given to them in this section unless the 12 context clearly indicates otherwise: 13 * * * 14 "Annuity jackpot." A slot machine jackpot offered by a slot 15 machine licensee or a progressive payment from a progressive 16 system in which a patron wins the right to receive fixed cash
1 payments at specified intervals in the future. 2 * * * 3 Section 2. Title 4 is amended by adding a section to read: 4 § 1332. Report to department of annuity jackpot winners. 5 (a) Duty to report.--A slot machine licensee that awards an 6 annuity jackpot shall within 14 days report to the department 7 the name, address and Social Security number of each annuity 8 jackpot winner and the amount of the pending payments. 9 (b) Duty to forward to central registry.--The department 10 shall immediately forward the report received under subsection 11 (a) to the Department of Public Welfare for inclusion of the 12 information into the central registry maintained by the 13 Department of Public Welfare under 23 Pa.C.S. § 4376 (relating 14 to central registry) and in order to conduct a cross-check of 15 the information to the data in the central registry to identify 16 a match. 17 (c) Child support arrears match.-- 18 (1) If it appears to the Department of Public Welfare, 19 from the information received by it under subsection (b), 20 that an annuity jackpot winner is in arrears of a child 21 support order, the Department of Public Welfare shall within 22 14 days notify the Department of Revenue. 23 (2) On receipt of notice from the Department of Public 24 Welfare under paragraph (1), the Department of Revenue shall 25 within 14 days notify the slot machine licensee of the name, 26 address, Social Security number and amount due on an arrears 27 child support order. 28 (3) The slot machine licensee shall withhold this amount 29 from the pending annuity jackpot payment and transmit the 30 amount to the Department of Public Welfare, in accordance 20050H1111B1318 - 2 -
1 with regulations of the Department of Public Welfare. 2 (4) The Department of Public Welfare, acting as agent 3 for the child support payee, shall have a lien on the 4 proceeds of the annuity jackpot payment in an amount equal to 5 the amount of the child support arrearage. The lien imposed 6 under this subsection shall be enforceable as provided by 7 law. 8 (5) Any of the annuity jackpot winner's funds remaining 9 after withholding the appropriate amount under the lien shall 10 be paid to the annuity jackpot winner in accordance with the 11 rules of the board. 12 Section 3.
