           REPRESENTATIVES, AS AMENDED, APRIL 28, 1987

                                     AN ACT

     1  Amending the act of June 18, 1984 (P.L.384, No.81), entitled "An
     2     act providing for the inspection of amusement rides and
     3     attractions; granting powers and imposing duties on the
     4     Department of Agriculture; creating the Amusement Ride Safety
     5     Advisory Board; and imposing civil and criminal penalties,"
     6     providing for self-insurance by owners and operators; and
     7     imposing duties upon the Insurance Commissioner SECRETARY OF   <--
     8     AGRICULTURE.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  The heading of section 14 of the act of June 18,
    12  1984 (P.L.384, No.81), known as the Amusement Ride Inspection
    13  Act, is amended and the section is amended by adding a
    14  subsection to read:
    15  Section 14.  Insurance and self-insurance.

    17     (d)  Self-insurance.--An owner or operator, in lieu of
    18  furnishing the certificate of insurance required by subsection
    19  (c), may file, annually, with the department a certificate of
    20  self-insurance, approved for said period by the Insurance         <--

     1  Commissioner. The Insurance Commissioner SECRETARY. THE           <--
     2  SECRETARY may issue a certificate of self-insurance upon receipt
     3  of satisfactory evidence that the owner or operator possesses
     4  reliable financial arrangements, deposits, resources or
     5  commitments such as will equal or exceed the minimum amount of
     6  insurance required by subsection (a) that are available and will  <--
     7  remain available for the purpose of self-insurance against
     8  liability HAS SET ASIDE ASSETS EQUAL TO THE INSURANCE REQUIRED    <--
     9  TO SECURE ITS OBLIGATION AS A SELF-INSURER. Nothing in this act
    10  shall be construed as limiting the size of any liability damage
    11  award against any owner or operator to the amount of any
    12  required insurance or self-insurance required by this act. The
    13  Insurance Commissioner SECRETARY shall promulgate rules and       <--
    14  regulations to implement this subsection.
    15     Section 2.  This act shall take effect in 60 days.
