AN ACT
Providing for legal effect of surplus personal property disposed
of by municipal officials and employees in support of the
Ukrainian Government during 2022.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Short title.
This act shall be known and may be cited as the Municipal
Surplus Property Disposition Act.
Section 2. Legislative finding.
The General Assembly finds and declares that it is in the
national interest of the United States of America and the
interests of this Commonwealth and municipalities to support the
people of Ukraine resisting the invasion by the Russian
Federation that commenced on February 24, 2022.
Section 3. Disposition of municipal surplus property.
Notwithstanding any provision of law to the contrary, an
elected or appointed official or employee of a municipality who
RECEIVES OFFICIAL APPROVAL OF THE GOVERNING BODY, in good faith,

disposes of surplus personal property of the municipality by
gift or donation to a charitable organization, nongovernmental
organization, agency of the Federal Government, another state or
foreign government in support of the Ukrainian Government or
Ukrainian citizens shall not constitute a financial loss for
which the elected or appointed official or employee may be
subject to surcharge by auditors as provided by law.
Section 4. Retroactive application.
This act shall apply retroactively to February 24, 2022.
Section 5. Expiration.
This act shall expire December 31, 2023 2024.
Section 6. Effective date.
This act shall take effect immediately.
