                                     AN ACT

     1  Amending the act of June 3, 1937 (P.L.1333, No.320), entitled
     2     "An act concerning elections, including general, municipal,
     3     special and primary elections, the nomination of candidates,
     4     primary and election expenses and election contests; creating
     5     and defining membership of county boards of elections;
     6     imposing duties upon the Secretary of the Commonwealth,
     7     courts, county boards of elections, county commissioners;
     8     imposing penalties for violation of the act, and codifying,
     9     revising and consolidating the laws relating thereto; and
    10     repealing certain acts and parts of acts relating to
    11     elections," extending the time records must be preserved by
    12     County Boards of Election.

    13     The General Assembly of the Commonwealth of Pennsylvania
    14  hereby enacts as follows:
    15     Section 1.  Section 309, act of June 3, 1937 (P.L.1333,
    16  No.320), known as the "Pennsylvania Election Code," amended July
    17  14, 1961 (P.L.648, No.334), is amended to read:
    18     Section 309.  Preservation of Records.--All documents, papers
    19  and records in the office of the county board of elections of
    20  each county shall be preserved therein for a period of at least
    21  [eleven (11) months,] two (2) years and all official ballots and
    22  the contents of ballot boxes shall be preserved therein for a
    23  period of at least four (4) months; in the event the county

     1  board has been notified in writing by the district attorney of
     2  the county, or by a judge of a court of record, to preserve said
     3  papers or contents of ballot boxes for a longer period of time,
     4  for the purposes of pending prosecution or litigation, said
     5  records shall be preserved accordingly.
     6     Section 2.  This act shall take effect in 60 days.
