                                     AN ACT

     1  Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
     2     act to consolidate, editorially revise, and codify the public
     3     welfare laws of the Commonwealth," providing penalties for
     4     the operation of family day-care homes in violation of
     5     registration requirements or regulations.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  The act of June 13, 1967 (P.L.31, No.21), known
     9  as the Public Welfare Code, is amended by adding a section to
    10  read:
    11     Section 1081.  Operation in Violation of Registration
    12  Requirements or Regulations.--Any individual who operates a
    13  family day care home in violation of the requirements under
    14  which a registration certificate was issued, or in violation of
    15  regulations of the department, including, but not limited to,
    16  regulations establishing fire and safety standards, shall, upon
    17  conviction, pay a fine of not less than twenty dollars ($20) nor
    18  more than one hundred dollars ($100) and costs of prosecution.

     1  Each day of operating in violation of the requirements of the
     2  registration certificate or regulations of the department shall
     3  constitute a separate offense. The penalty authorized by this
     4  section shall be in addition to any other action which may be
     5  taken by the department under sections 1079 and 1080.
     6     Section 2.  This act shall take effect in 60 days.
