AN ACT
1 Amending the act of May 1, 1984 (P.L.206, No.43), entitled "An
2 act providing for safe drinking water; imposing powers and
3 duties on the Department of Environmental Resources in
4 relation thereto; and appropriating certain funds," further
5 providing for the power of the Department of Environmental
6 Resources relating to the disposition of certain civil
7 penalties.
8 The General Assembly of the Commonwealth of Pennsylvania
9 hereby enacts as follows:
10 Section 1. Section 14 of the act of May 1, 1984 (P.L.206,
11 No.43), known as the Pennsylvania Safe Drinking Water Act, is
12 amended to read:
13 Section 14. Safe Drinking Water Account.
14 [All] (a) General rule.--Except as provided in subsection
15 (b), all fines and penalties collected under the penalty
16 provisions of this act and all fees shall be paid into the State
17 Treasury into a special restricted receipt account in the
18 General Fund known as the Safe Drinking Water Account
19 administered by the department for use in protecting the public
20 from the hazards of unsafe drinking water and which funds are
1 hereby appropriated to the department for such purposes as are
2 authorized in this act.
3 (b) Fines returned to consumer.--The department shall have
4 the power and may order any supplier of water assessed a civil
5 penalty under this act for any violations relating to the
6 quantity or quality of drinking water furnished to consumers to
7 return all or any portion of that civil penalty to affected
8 consumers.
9 Section 2. This act shall take effect in 60 days.
