                                     AN ACT

     1  Amending the act of December 7, 1982 (P.L.784, No.225), entitled
     2     "An act relating to dogs, regulating the keeping of dogs;
     3     providing for the licensing of dogs and kennels; providing
     4     for the protection of dogs and the detention and destruction
     5     of dogs in certain cases; regulating the sale and
     6     transportation of dogs; declaring dogs to be personal
     7     property and the subject of theft; providing for the
     8     assessment of damages done to livestock, poultry and domestic
     9     game birds; providing for payment of damages by the
    10     Commonwealth in certain cases and the liability of the owner
    11     or keeper of dogs for such damages; imposing powers and
    12     duties on certain State and local officers and employees;
    13     providing penalties; and creating a Dog Law Restricted
    14     Account," further providing for license fees.

    15     The General Assembly of the Commonwealth of Pennsylvania
    16  hereby enacts as follows:
    17     Section 1.  Section 201 of the act of December 7, 1982
    18  (P.L.784, No.225), known as the Dog Law, is amended to read:
    19  Section 201.  Applications for licenses; fees; county treasurers
    20                as agents.
    21     (a)  General rule.--Except as provided in subsection (b), on
    22  or before January 1 of each year, the owner of any dog, six
    23  months of age or older, except as hereinafter provided, shall

     1  apply to the county treasurer of his respective county or his
     2  authorized agent, on a form prescribed by the department for a
     3  license for such dog. The application and license certificate
     4  shall state the breed, sex, age, color and markings of such dog,
     5  and the name, address and telephone number of the owner. The
     6  application shall be accompanied by a license fee of $2.50 for
     7  each neutered male dog and for each spayed female dog for which
     8  the certificate of a veterinarian or the affidavit of the owner
     9  is produced, and by a license fee of $4.50 for all other male
    10  and female dogs. For Pennsylvania residents 65 years of age or
    11  older, the license fee shall be $1.25 for each neutered male dog
    12  and for each spayed female dog for which the certificate of a
    13  veterinarian or the affidavit of the owner is produced, and the
    14  license fee shall be $2.25 for all other male or female dogs.
    15  When the license is issued by the county treasurer, an
    16  additional service fee of 50¢ shall be paid by all applicants
    17  regardless of age to the county treasurer for the use of the
    18  county. The county treasurers of this Commonwealth shall be
    19  agents of the Commonwealth for the collection of license fees.
    20  All county treasurers shall [pay] donate all license fees
    21  collected [through the Department of Agriculture into the State
    22  Treasury for credit to the Dog Law Restricted Account] to the
    23  local humane society.
    24     (b)  Lifetime license.--The owner of any dog six months of
    25  age or older which has been tattooed with identification numbers
    26  may apply to the county treasurer of his respective county or
    27  his authorized agent, on a form prescribed by the department for
    28  a lifetime license for such a dog. The application and license
    29  certificate shall state the breed, sex, age, color and markings
    30  of such a dog, the identifying tattoo number, and the name,

     1  address and telephone number of the owner. The application shall
     2  be accompanied by a license fee of $10 for each neutered male
     3  dog and for each spayed female dog for which the certificate of
     4  a veterinarian or the affidavit of the owner is produced, and by
     5  a license fee of $20 for all other male and female dogs. For
     6  Pennsylvania residents 65 years of age or older, the license fee
     7  shall be $5 for each neutered male dog and for each spayed
     8  female dog for which the certificate of a veterinarian or the
     9  affidavit of the owner is produced, and $10 for all other male
    10  and female dogs. When the license is issued by the county
    11  treasurer, an additional service fee of 50¢ shall be paid by all
    12  applicants regardless of age to the county treasurer for the use
    13  of the county. The department shall promulgate regulations to
    14  provide for the registration of lifetime tattoo identification
    15  numbers with the department.
    16     Section 2.  This act shall take effect in 60 days.
