                                     AN ACT

     1  Amending the act of April 9, 1929 (P.L.177, No.175), entitled
     2     "An act providing for and reorganizing the conduct of the
     3     executive and administrative work of the Commonwealth by the
     4     Executive Department thereof and the administrative
     5     departments, boards, commissions, and officers thereof,
     6     including the boards of trustees of State Normal Schools, or
     7     Teachers Colleges; abolishing, creating, reorganizing or
     8     authorizing the reorganization of certain administrative
     9     departments, boards, and commissions; defining the powers and
    10     duties of the Governor and other executive and administrative
    11     officers, and of the several administrative departments,
    12     boards, commissions, and officers; fixing the salaries of the
    13     Governor, Lieutenant Governor, and certain other executive
    14     and administrative officers; providing for the appointment of
    15     certain administrative officers, and of all deputies and
    16     other assistants and employes in certain departments, boards,
    17     and commissions; and prescribing the manner in which the
    18     number and compensation of the deputies and all other
    19     assistants and employes of certain departments, boards and
    20     commissions shall be determined," providing for certain
    21     employment standards in the Department of Transportation and
    22     initiation of a productivity program.

    23     The General Assembly of the Commonwealth of Pennsylvania
    24  hereby enacts as follows:
    25     Section 1.  The act of April 9, 1929 (P.L.177, No.175), known
    26  as "The Administrative Code of 1929," is amended by adding a
    27  section to read:
    28     Section 2013.  Departmental Employment Standards.--(a)  The


     1  Civil Service Commission, with the assistance of the Department
     2  of Transportation, shall establish appropriate occupational
     3  experience and competency requirements or appropriate
     4  educational experience requirements in lieu of occupational
     5  experience requirements for each employment position and each
     6  employment position hereafter created in the department which is
     7  not subject to the provisions of the act of August 5, 1941
     8  (P.L.752, No.286), known as the "Civil Service Act."
     9     (b)  The commission shall submit the employment requirements
    10  and examination standards established under this section to the
    11  Executive Board for final approval within nine (9) months after
    12  this act takes effect or sixty (60) days after an employment
    13  position is created whichever is applicable.
    14     (c)  The Executive Board shall resolve any dispute between
    15  the department and the Civil Service Commission with respect to
    16  appropriate examination standards, occupational experience
    17  requirements and educational experience requirements.
    18     (d)  The department shall submit a final report to the
    19  General Assembly within fifteen (15) months after this
    20  amendatory act takes effect, which report shall set forth in
    21  detail the manner in which this section has been implemented.
    22     (e) (1)  The Civil Service Commission shall administer a
    23  written employment examination qualification standards
    24  established by the commission and approved by the Executive
    25  Board, and where appropriate, mechanical and occupational
    26  aptitude employment qualification examination shall be a
    27  condition for retaining or obtaining any employment position
    28  existing or hereinafter created in the department subject to the
    29  provisions of this act.
    30     (2)  The Department of Transportation shall make available

     1  necessary equipment for mechanical or occupational aptitude
     2  testing. The Civil Service Commission may employ consultants,
     3  temporary personnel, and recognized, qualified testing services
     4  with experience in devising and administering mechanical and
     5  occupational aptitude examinations.
     6     (f)  In addition to employment positions covered under civil
     7  service or required to be covered under civil service by Federal
     8  law, rule or regulation, the positions which may only be filled
     9  by a person who has been confirmed by the Senate shall be
    10  excluded from the provisions of this section.
    11     (g)  All personnel in the Department of Transportation on the
    12  effective date of this act who are not in the "classified
    13  service," but who are included under the provisions of this
    14  amendatory act shall, except as hereinafter provided, serve a
    15  maximum probationary period of no more than one hundred twenty
    16  (120) days, beginning one (1) year after the effective date of
    17  this act. County maintenance superintendents and assistant
    18  county maintenance superintendents employed by the department on
    19  the effective date of this act shall be ineligible to hold a
    20  position in the department until qualified under the
    21  requirements established herein beginning one (1) year after the
    22  effective date of this act.
    23     Section 2.  This act shall take effect immediately.
