AN ACT

 

1Amending Title 23 (Domestic Relations) of the Pennsylvania
2Consolidated Statutes, in adoption, further providing for
3report of intermediary.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 2533(d) of Title 23 of the Pennsylvania
7Consolidated Statutes is amended to read:

8§ 2533. Report of intermediary.

10(d) Permissible reimbursement of expenses.--Payments made by
11the adoptive parents to an intermediary or a third party for
12reimbursement of the following expenses, calculated without
13regard to the income of the adoptive parents, are permissible
14and are not in violation of 18 Pa.C.S. § 4305 (relating to
15dealing in infant children):

16(1) Medical and hospital expenses incurred by the
17natural mother for prenatal care and those medical and
18hospital expenses incurred by the natural mother and child
19incident to birth.

1(2) Medical, hospital and foster care expenses incurred
2on behalf of the child prior to the decree of adoption.

3(3) Reasonable expenses incurred by the agency or a
4third party for adjustment counseling and training services
5provided to the adoptive parents and for home studies or
6investigations.

7(4) Reasonable administrative expenses incurred by the
8agency, to include overhead costs and attorney fees.

9(5) Reasonable living expenses incurred by the natural
10mother three months prior to the due date of the child and 60
11days after the birth of the child. Living expenses shall
12include food, rent, utilities, maternity clothing and an
13amount not to exceed $300 for expenses and transportation
14costs associated with prenatal, maternity and postmaternity
15care.

16Section 2. This act shall take effect in 60 days.
