                                     AN ACT

     1  Amending the act of April 12, 1951 (P.L.90, No.21), entitled "An
     2     act relating to alcoholic liquors, alcohol and malt and
     3     brewed beverages; amending, revising, consolidating and
     4     changing the laws relating thereto; regulating and
     5     restricting the manufacture, purchase, sale, possession,
     6     consumption, importation, transportation, furnishing, holding
     7     in bond, holding in storage, traffic in and use of alcoholic
     8     liquors, alcohol and malt and brewed beverages and the
     9     persons engaged or employed therein; defining the powers and
    10     duties of the Pennsylvania Liquor Control Board; providing
    11     for the establishment and operation of State liquor stores,
    12     for the payment of certain license fees to the respective
    13     municipalities and townships, for the abatement of certain
    14     nuisances and, in certain cases, for search and seizure
    15     without warrant; prescribing penalties and forfeitures;
    16     providing for local option, and repealing existing laws,"
    17     appropriating funds to the Department of Health for the study
    18     of problems and promotion of programs relating to alcoholism
    19     and the rehabilitation and treatment of alcoholics.

    20     The General Assembly of the Commonwealth of Pennsylvania
    21  hereby enacts as follows:
    22     Section 1.  Section 802, act of April 12, 1951 (P.L.90,
    23  No.21), known as the "Liquor Code," amended September 28, 1961
    24  (P.L.1728, No.702), is amended to read:
    25     Section 802.  Moneys Paid Into The State Stores Fund for Use
    26  of the Commonwealth.--(a)  All moneys, except fees to be paid

     1  into the Liquor License Fund as provided by the preceding
     2  section, collected, received or recovered under the provisions
     3  of this act for license fees, permit fees, filing fees and
     4  registration fees, from forfeitures, sales of forfeited
     5  property, compromise penalties and sales of liquor and alcohol
     6  at the Pennsylvania Liquor Stores, shall be paid into the State
     7  Treasury through the Department of Revenue into a special fund
     8  to be known as "The State Stores Fund."
     9     (b)  One-half of all application, filing and transfer fees
    10  shall be credited to a special account designated as the
    11  Enforcement Officers' Retirement Account. The moneys credited to
    12  this account shall be paid, annually, by the board to the State
    13  [Employes'] Employees' Retirement Board to be paid into the
    14  State [Employes'] Employees' Retirement Fund and credited to the
    15  Enforcement Officers' Benefit Account.
    16     (c)  Two per centum of the net revenue of the Pennsylvania
    17  Liquor Control Board as shown on the operating statement in its
    18  annual report is hereby appropriated to the Governor's Council
    19  on Drug and Alcohol Abuse to be used for the:
    20     (1)  study of the problem of alcoholism;
    21     (2)  treatment and rehabilitation of persons addicted to the
    22  excessive use of alcoholic beverages; and
    23     (3)  promotion of preventive and educational programs
    24  designed to eliminate alcoholism.
    25     (d)  All other moneys in such fund shall be available for the
    26  purposes for which they are appropriated by law.
    27     Section 2.  This act shall take effect immediately.
