AN ACT

 

1Amending the act of August 5, 1941 (P.L.752, No.286), entitled
2"An act regulating and improving the civil service of certain
3departments and agencies of the Commonwealth; vesting in the
4State Civil Service Commission and a Personnel Director
5certain powers and duties; providing for classification of
6positions, adoption of compensation schedules and
7certification of payrolls; imposing duties upon certain
8officers and employes of the Commonwealth; authorizing
9service to other State departments or agencies and political
10subdivisions of the Commonwealth in matters relating to civil
11service; defining certain crimes and misdemeanors; imposing
12penalties; making certain appropriations, and repealing
13certain acts and parts thereof," further providing for powers
14and duties of director.

15The General Assembly of the Commonwealth of Pennsylvania
16hereby enacts as follows:

17Section 1. Section 206 of the act of August 5, 1941
18(P.L.752, No.286), known as the Civil Service Act, amended
19November 27, 2002 (P.L.1129, No.140), is amended to read:

20Section 206. Powers and Duties of Director.--Under the
21direction and supervision of the commission, the director,
22except as otherwise provided in this act, shall direct and
23supervise the administrative work of the commission. The

1director shall have power and the duty--

2(1) To appoint such staff to classified service positions as
3may be necessary to carry out this act and to supervise and
4direct this work.

5(2) To attend the meetings of the commission.

6(3) To prepare and recommend to the commission rules and
7amendments thereto.

8(4) To establish and maintain a record of all employes in
9the classified service, showing such data as the director
10considers desirable and pertinent.

11(5) To administer and make effective the provisions of this
12act and of the rules made thereunder, including those relating
13to the preparation and conduct of examinations, the preparation
14of eligible lists, the certification of persons qualified for
15employment, the transfer, promotion, suspension, demotion,
16removal, furlough, leave of absence and resignation of employes,
17the rating of employes' services, the requiring of health
18examinations at the discretion of appointing authorities as a
19condition of initial or continued employment.

20(6) To investigate the effect of the administration of this
21act and of the rules made thereunder and to report his findings
22and recommendations to the commission.

23(8) To make an annual report in writing, not later than
24November first of each year, concerning the administrative and
25legal work performed by the commission during the preceding
26fiscal year.

27(9) To do any act or acts required by this act, or directed
28by the commission, or the rules made thereunder.

29(10) To request assistance, from among the attorneys
30appointed under section 204.1, such legal counsel as may be

1necessary in the performance of his administrative duties.

2(11) To advertise, on the commission website and in all
3commission announcements, advertisements and examination
4materials, that veterans' preference is the law of this
5Commonwealth and that, under 51 Pa.C.S. § 7103 (relating to
6additional points in grading civil service examinations), an
7additional ten points will be applied to a veteran's final
8examination score to determine standing on all certified
9eligibility lists.

10Section 2. This act shall take effect in 60 days.
