AN ACT 1 Amending the act of April 9, 1929 (P.L.177, No.175), entitled 2 "An act providing for and reorganizing the conduct of the 3 executive and administrative work of the Commonwealth by the 4 Executive Department thereof and the administrative 5 departments, boards, commissions, and officers thereof, 6 including the boards of trustees of State Normal Schools, or 7 Teachers Colleges; abolishing, creating, reorganizing or 8 authorizing the reorganization of certain administrative 9 departments, boards, and commissions; defining the powers and 10 duties of the Governor and other executive and administrative 11 officers, and of the several administrative departments, 12 boards, commissions, and officers; fixing the salaries of the 13 Governor, Lieutenant Governor, and certain other executive 14 and administrative officers; providing for the appointment of 15 certain administrative officers, and of all deputies and 16 other assistants and employes in certain departments, boards, 17 and commissions; and prescribing the manner in which the 18 number and compensation of the deputies and all other 19 assistants and employes of certain departments, boards and 20 commissions shall be determined," transferring the 21 administration of certain statutes from the Department of 22 Environmental Resources to the Department of Health; and 23 making a repeal. 24 The General Assembly of the Commonwealth of Pennsylvania 25 hereby enacts as follows: 26 Section 1. Section 1901-A(6), (8), (9), (11), (12), (13), 27 (14), (21) and (22) of the act of April 9, 1929 (P.L.177,
1 No.175), known as The Administrative Code of 1929, are repealed. 2 Section 2. The act is amended by adding a section to read: 3 Section 2123. Additional Powers and Duties.--The Department 4 of Health shall administer the following: 5 (1) The control of nuisances from grounds, vehicles, 6 apartments, buildings and places within this Commonwealth, the 7 sanitary condition of tenements, lodging and boarding houses, 8 the management of the sanitary affairs of the Commonwealth, the 9 issuance of waterworks permits and the control of water 10 pollution. 11 (2) The Sanitary Water Board. 12 (3) The act of June 23, 1931 (P.L.899, No.299), known as the 13 "Public Bathing Law." 14 (4) The act of May 23, 1945 (P.L.926, No.369), referred to 15 as the Public Eating and Drinking Place Law. 16 (5) The act of August 20, 1953 (P.L.1217, No.339), entitled 17 "An act providing for payments by the Commonwealth to 18 municipalities which have expended money to acquire and 19 construct sewage treatment plants in accordance with the Clean 20 Streams Program and the act, approved the twenty-second day of 21 June, one thousand nine hundred thirty-seven (Pamphlet Laws 22 1987), and making an appropriation." 23 (6) The act of November 10, 1959 (P.L.1400, No.497), 24 entitled "An act providing for the annual registration of 25 organized camps for children, youth and adults; defining the 26 duties of the Department of Health of the Commonwealth of 27 Pennsylvania; and prescribing penalties." 28 (7) The act of January 24, 1966 (1965 P.L.1535, No.537), 29 known as the "Pennsylvania Sewage Facilities Act." 30 (8) The act of November 18, 1968 (P.L.1052, No.322), known 19930H0485B0536 - 2 -
1 as the "Sewage Treatment Plant and Waterworks Operators' 2 Certification Act." 3 (9) As much of the act of June 23, 1978 (P.L.537, No.93), 4 known as the "Seasonal Farm Labor Act," as relates to the 5 Department of Environmental Resources. 6 (10) The act of May 1, 1984 (P.L.206, No.43), known as the 7 "Pennsylvania Safe Drinking Water Act." 8 Section 3. (a) All personnel, allocations, equipment, 9 files, records, contracts, agreements, obligations and other 10 materials which are used, employed or expended in connection 11 with the powers, duties or functions heretofore exercised by the 12 Department of Environmental Resources in connection with those 13 responsibilities transferred by this act to the Department of 14 Health, as described in section 2, are hereby transferred from 15 the Department of Environmental Resources to the Department of 16 Health with the same force and effect as if the appropriations 17 had been made to and said items had been the property of the 18 Department of Health in the first instance and as if said 19 contracts, agreements and obligations had been incurred or 20 entered into by the Department of Health. 21 (b) All personnel transferred pursuant to this act shall 22 retain any civil service employment status held by said 23 personnel. 24 Section 4.
